No difference in process between the two scenarios is contemplated (i.e. not "until the President elect shall have qualified"). If the intent was for the VP to get a full term out of this, 20th would have paired "failure to qualify" with "failure to live" in the prior sentence, sans "acting" label.

Failure to qualify is dealt with in the same sentence as failure to choose, with the same, single prescription for both: VP serves as acting president only "until a President shall have qualified."

"Acting president" is "until someone qualifies," not One Weird Trick around the 12th. If Trump's votes are rejected and a House vote deemed necessary, a party line vote between Harris and "present" still wins her 38 states (every state with at least 1 Democrat). Nominations closed on 12/17.

Lifting ban under the 14th requires 2/3 of both houses. If at least one house has such a vote and it fails to reach the 2/3 threshold, it demonstrates the ban (found by 3 states, never directly addressed by SCOTUS) still stands.

Enforce 14th Amdt. disqualification retroactively to Inauguration Day (if not de jure 1/6/21). Vance serves as "acting president" (as per 20th under "failure to qualify") just long enough for Harris to find a federal judge to swear her in (only non-disqualified candidate with electoral votes).

Can't quite tell from the clip if the comparison was complimentary or derogatory. If it's derogatory, that implies that 1/6/21 was, y'know, an insurrection. And that would disqualify anybody who gave aid or comfort to the insurrection from, say, occupying the White House. #14thNow

Seriously, in 1787 the Constitutional Convention was anxious about a state's willingness to protect the future Capitol, so they insisted on the ten-mile square. In 2021, Maryland and Virginia were both more eager to defend the Capitol than was the President or, ultimately, Congress itself.

Speaking of the MDNG, remember when the Capitol needed saving 4 years ago? Remember when Trump's Pentagon dragged their feet in giving them permission to enter DC and save Congress? Stuff like that is why Trump (among others) is constitutionally barred from serving as President again. #14thNow
