Well. That’s…interesting. On August 3, AIFC sold ALT5 Sigma Canada to Prime Delta—the company ALT5 had sued months earlier—and kept the billions of WLFI. On September 4, Canada revoked ALT5 Canada’s MSB registration. I have some questions.

AIFC (aka Alt5) was dropped from the S&P Global BMI last night. Today the stock is down about 8%, leaving the whole company worth roughly $66M. AIFC says it holds more than 7.28 BILLION WLFI—worth roughly $415M at today’s price. $415M in WLFI. $66M company. That is one hell of a discount.

CLARITY didn’t leave crypto unregulated. It left the rules in the hands of whoever runs the agencies. Atkins and Selig can keep building the framework now. The next chairmen can reverse it. Congress failed to make the rules durable. That’s the consequence.

Republicans changed the CLARITY ethics language. They did NOT change the conflict. Trump can keep the money. World Liberty Financial can keep operating. Congress can still call it compliance. They changed what legally counts as Trump — and gave themselves cover to say they fixed it.

September 15 is the test. Cloture takes 60 votes. Republicans hold 53 seats, and GOP defections are expected. Democrats and independents still have to supply crossover votes to move CLARITY forward.

The ethics rule still starts late and applies only prospectively. Anything before the effective date stays outside the prohibition. After months of complaints that the rule was too weak, Congress kept the delayed start. Still there.

The same 20% ownership / 50% revenue thresholds still decide when an equity interest becomes a “direct interest.” Congress did not ban the financial relationship. It drew a line around how much of it counts. Still there.

A preexisting issuer can still use the official’s name, image or likeness — even while minting, selling or distributing more digital assets — after divestment or placement in a blind trust. The branding machine gets to keep running. Still there.

The penalty is still disgorgement plus 10% of the consideration or $500,000 — whichever is less. For potentially enormous crypto transactions, Congress deliberately kept the smaller number. Still there.

Only the Attorney General can bring the ethics case. Not state attorneys general. Not private plaintiffs. The president’s own Justice Department remains the gatekeeper for enforcing the rule against him. Still there.

Trump can still hold digital assets as investments while taking official government action on crypto policy, legislation and regulation. The law does not eliminate the conflict. It explicitly permits both sides of it to continue. Still there.
