We cannot fix a system that prioritizes humiliation and punishment by expanding the very laws that created the current immigration system. Congress must reverse IIRIRA and AEDPA’s harmful legacy and advance solutions that promote safety, fairness, and due process.

IIRIRA and AEDPA’s harmful legacy are still felt today through legislation like the Laken Riley Act and the introduction of a slate of bills that would further gut due process and impose severe consequences in people’s immigration cases.

Since 2019, at least 16 people have died by suicide while in the NYC Department of Correction custody. Missed medical appointments, poor access to medication, and overcrowding in specialized mental health units are persistent problems.

Most people on Rikers have not been convicted of a crime and are waiting to go to trial. Among them, 60% of people are flagged for mental health needs and are more likely to stay in jail longer. This August, more than 3,900 people on Rikers needed mental health services.
