This is a good question. NY once had a loophole for “marital rape” that essentially presumed a woman preemptively consented to sex by marrying. The NYCOA struck that exception down on equal protection grounds in 1984. Could something similar happen here?

Similarly, the “voluntary intoxication” loophole relies on a fiction that agreeing to consume an intoxicant is consent to sex. Justice for the victim would have that law changed, too.

It was once legal in NY for a husband to rape his wife. The “marital rape” exception relied on a fiction that the wife preemptively consented to sex by marrying. That law only changed in 1984.

It jumped out at me recently after someone played video of Trump complaining during the Obama admin about State dinners, followed immediately by Trump talking about his meetings with Xi. Whether it’s caused by meds, a stroke, or general mental decline, the slurring is really prominent now.

Kevin McCarthy had no power over Jack Smith or Merrick Garland. While I admire both Smith and Garland, they both fumbled. When lawyers as good as those two, with facts as good as they had, can’t get a prosecution done in the years they had to do them, it doesn’t inspire confidence. I hope I’m wrong.

State actions against EOs and gerrymandering are civil litigation, not criminal prosecutions. While I applaud Letitia James for her convictions back in May 2024 (when Biden was in office), I’m not aware of her bringing anything since. Do you contend that everything that could be done, has been done?

The Jan. 6 hearings were well orchestrated, and they did expose lies and corruption. But, to what end? There were no new prosecutions, Trump was reelected, and he pardoned the Jan. 6th felons. One could argue that exposing corruption, but failing to punish it, encourages more corruption.
