A few weeks back someone was asking how the US legal system could be so impotent and accommodating of the Trump admin's incursions, and at the time I was reading 'A Nation of Enemies: Chile Under Pinochet'. This passage, about Chile's courts and judges, was instructive then, and resonates here.
The courts' reluctance to take aggressive action against the regime's abuses had equally deep roots in the formalistic legal philosophy taught in Chile's law schools, following the country's Civil Code tradition. Adhering to the precepts of European positivist doctrine that aimed at building the perfect society through enlightened legal codes, Chile's judges were trained to believe that,
"when the sense of the law is clear, you cannot ignore its literal tenor on the pretext of interpreting its spirit. "40
In Chile, it was heresy to think that the law could be interpreted more broadly to fit higher principles of justice or to respond to changing social realities. "Here, there has always been the notion that the law solves everything. It is not just respect; it is exaggerated fetishism for the law," noted Judge Germán Hermosilla, who became a quiet but determined champion of judicial reform after winning the presidency of the National Magistrates' Association in 1986.41The dispute between Allende and the Supreme Court had hinged on two sharply opposed concepts of the role of judges. Allende contended that all laws were subject to interpretation and that the courts were refusing to adapt to the "new realities" of Chilean society.4 The justices retorted that if the executive did not like the laws, it should seek to change them. But with no majority in Con-gress, Allende was unable to do so, and his judicial adversaries could always find a legal text that stymied his controversial initia-tives.With the coup, the impasse between executive and legislature was neatly resolved, and the regime needed only four signatures to

create or change the law. Instead of defying the juridical order, the junta used it to construct an elaborate façade of legitimacy around dictatorial rule. From their first days in power, the commanders issued a stream of decree laws, duly debated and signed, that granted the regime a widening range of repressive powers-from the right to censor news and rescind citizenship to the authority to hold prisoners "incomunicado" without charge for five days or banish dissidents to remote villages for three months at a time.
"We thought we were embarked on a mission that was best for the country. I really believed we were fighting for freedom," recalled Mónica Madariaga, whose typewriter in a tiny cubicle near Pinochet's office cranked out drafts for hundreds of early regime laws. 43The courts, which had balked so indignantly at the "illegiti-macy" of Allende's elected government, immediately accepted the new authoritarian law-making process. Although many of the regime's executive actions and decree laws clearly defied existing statutes and the 1925 constitution, the veneer of legal formality gave timid, mediocre, or conservative judges a perfect rationale for avoiding sensitive issues. If military officials swore someone had not been detained and a string of witnesses contradicted them, for example, the law permitted a judge to reject the case for lack of conclusive proof.
"Most judges were neither cowards nor heroes. They simply kept on applying the law as they always had, even though the circumstances had changed," observed one veteran appeals court judge with a reputation for independence. "Society expected them to put a brake on executive power, but just as in Nazi Germany or (Fascist] Italy, the courts were not prepared to confront an institutional crisis. The world had turned upside down, but the machinery kept functioning. "44
