This is exactly the problem with the EHRC’s framing. Trans people still have protections under the Equality Act. But that does not mean the Supreme Court judgment didn’t change their legal rights and status. transparentlyuk.substack.com/p/trans-peop...

Trans people still have legal protections. That doesn’t mean they haven’t lost rights. The Supreme Court changed the legal position of trans people with GRCs under the Equality Act. The EHRC’s response seems to count only the protections that remain. transparentlyuk.substack.com/p/trans-peop...

The claim that Parliament never intended the Equality Act to treat trans people with GRCs as their acquired sex doesn’t survive contact with the parliamentary record. I’ve gone back to what MPs actually said when the legislation was debated. transparentlyuk.substack.com/p/what-parli...
