It’s so triggering (and I don’t use that word lightly) to be repeatedly ignored, dismissed, patronised and lied to by politicians and policy makers because it reflects how Alice and I were treated when she needed help and answers whilst she was alive. It is impossible for transitioned women in the UK to have certain jobs (like nursing), which would effectively mean perpetual outing and humiliation. The concept is segregation itself, in all its forms. Trans segregation is one of them. Let's not be shy about talking about the psychosocial outcomes.

The recent ruling does not only authorise exclusion. It also reveals the infrastructure obligation created by exclusion. If transitioned women are segregated out of women’s spaces, and male spaces are unsafe or degrading, ▶️ then the state has created a third category and must provide for it.

If transitioned women are not to be housed, treated, searched, supported, or accommodated as ordinary women, and if placing them with men creates Article 2/3 risks, trauma risks, safeguarding risks, or clinical unsuitability, then the answer is not abandonment. The answer is equivalent provision.

If transitioned women are excluded from women’s provision and male provision is unsafe, degrading or clinically inappropriate, then equivalent transitioned-women-specific provision is not a luxury. It is the logical consequence of the state’s own segregation model.

The recent prison ruling does not erase transitioned women’s rights. It confirms that, where sex segregation is applied as a bright-line rule, authorities may still need specific arrangements for transitioned people, including provision separate from both ordinary male and female accommodation.

The current EHRC draft Code recognises gender reassignment as a protected characteristic and discusses “alternative” arrangements where trans people are excluded from single-sex provision, but that is much weaker than a full duty to provide equivalent transitioned-women-specific services.
