Should governments be allowed to freeze self-custodied Bitcoin? Not Bitcoin held by an exchange. Bitcoin held directly by the owner. What should the law say? A) Never, if self-custodied B) Only with court order C) Yes, for any crime D) Depends on the offense

I thought people needed better Bitcoin legal news. Turns out, many first need a better map of how US law works. A bill is a proposal. Congress passes it. The President signs it. Then it becomes law.

Every Tuesday, I take one real legal or political question from a Bitcoiner and give the answer in plain English. No price predictions. No altcoins. No legal theatre. Just: what does the law actually say? If you have the question you’d ask, send it my way!

The Bitcoin Act @thebitcoinact.xyz · 01/10/2026
That is the territory. Bitcoin gives you control over the asset. The law still decides what can happen around that control.

The harder questions: Can the state force you to hand over keys? What happens when a law written for banks gets applied to self-custody? When does protecting your bitcoin become a legal problem?

And from January, a second resolution lets institutions hold some outbound transfers before they go through. All this in the country Chainalysis ranks number one in the world for crypto adoption. Is $10,000 a reasonable line, or is this how self custody surveillance starts?

The Bitcoin Act @thebitcoinact.xyz · 01/10/2026
The new line sits in the same article of the anti money laundering rules as cash foreign exchange. Moving sats to your own wallet now gets the same treatment as walking into a bank with a bag of dollars. It doesn't ban holding your keys. It watches the door.

There is one important transition rule. Firms that apply during the application window can continue providing certain crypto services while their applications are assessed. That includes taking on new business, if they meet the relevant transitional conditions.

So existing crypto firms need to treat this as a fresh authorization process. The FCA says firms must meet the new requirements. The industry has also called for the process to be proportionate, especially for smaller and growing firms.

Already registered under the UK’s Money Laundering Regulations? That does not mean you are automatically authorized under the new FCA regime. Existing registration will not simply carry over.

The FCA will not simply approve every applicant. Firms will be assessed on: • Consumer protection • Customer-asset safeguarding • Market integrity • Financial resilience Authorization is not guaranteed.

The new regime will cover a broader range of crypto activities. That includes: • Trading • Transactions • Staking • Digital asset custody It also introduces new rules around cryptoasset admissions and disclosures.

📅 Feb. 28, 2027 That is the deadline for firms to apply for FCA authorization. 📅 Oct. 25, 2027 That is when the new crypto regime takes effect. Firms that want to continue operating need to prepare.

Friday, the SEC loses the only commissioner who ever actually stood up for bitcoin. No law passed this year. So two agencies are now writing bitcoin's rules on their own, and admitting in public those rules might not survive a courtroom challenge.
