The report alleges that the U.S. engaged in indiscriminate attacks affecting civilians and that Iran engaged in acts constituting "crimes against humanity" against its own population. At a minimum, the U.S. should hasten the publication of the Pentagon investigation and any accountability efforts.

Charitably, Sec. Rubio’s Op-Ed misses or overlooks numerous key issues, including limits on ICC jurisdiction, complementary, and existing obligations to avoid committing the most heinous crimes (to which Americans are bound). Reform is one thing; dismantling is unwise.

Although the U.S. is an influential actor, it cannot unilaterally change the international laws governing armed conflict. The U.S. remains a state party to numerous treaties, like the Geneva Conventions, that will remain in force despite overhauls in legal personnel.
