The Lemkin Institute for Genocide Prevention has twice issued formal warnings on this UK trajectory — June 2025 and again 20 June 2026 on the EHRC Code — describing the segregation pattern as consistent with early-stage genocide indicators. Not a legal verdict. A warning worth taking seriously.

Disability: the EHRC’s own Draft Code (para 2.48) says gender dysphoria meeting the s.6 test will be protected under the disability provisions — not “may.” Years-long GIC waits make the 12-month “long-term” limb almost automatic. KCSIE’s facilities rules say nothing about this.

There’s been a whole judicial review in Northern Ireland around the Gender Recognition Act around this and the meaning of the word ‘condition’. There has also been multiple interpretations undertaken to ensure private medical insurance still covers treatment both in the UK and worldwide see WHO.

That’s because under ICD-11 the diagnosis changed to gender incongruence a condition of sexual health rather than gender dysphoria a mental health problem and the NHS have been switching over the coding. It is easy to find gender incongruence for children and adults on NHS Digital
