Don't think Australia is immune to authoritarianism
Nobody wakes up to sudden authoritarianism. We relinquish ourselves to it by allowing our favoured government to get away with bending norms and rules. Over time, these bends become clean breaks.

Well that’s just not true, when it comes to the thousands of decisions made within departments that never see a minister. They are vested with extraordinary power, and the public role comes with scrutiny. Yes, even ridicule. Arguing against that is arguing against knowledge.

Exactly, but that’s the problem. Because some of those clips are extremely informative and just because they don’t like them doesn’t mean they shouldn’t be online. They are prompts, as this one was, for people like me to go and watch the full hearings. Or read transcripts.

Under the NACC Act, a completed investigation automatically triggers s.149 of the legislation, which mandates production of a report outlining its investigation, the steps taken, the evidence assessed and either what corrupt conduct was found or, if none was found, why none was found.

Anyway, good luck to the ANU's new Chancellor, former public service commissioner Gordon de Brouwer, who tried to argue before parliament in December that writing down the 'genuine' advice to govt on a yellow sticky note to be thrown away wasn't illegal.

De Brouwer initially responded: “No, it’s not illegal. They’ve given advice to ministers, they’ve just been selective in what they’ve written down.” 

Coalition Senator James Paterson caught the thread, asking: “How is that consistent with the public servant’s obligation to keep accurate records?”

“Well, I think that’s right,” de Brouwer said.

“And that’s what we found in robodebt was also people didn’t keep records.” 

De Brouwer, who led the Australian Public Service Commission during its disciplinary investigation into current and former public servants involved in the robodebt scheme, was pressed again by Patterson that he had just described something illegal. 

“I don’t know that sticky notes themselves are illegal,” he said. 

Patterson pushed: “But failing to keep records is.”

De Brouwer, who has just been appointed Chancellor at the scandal-plagued Australian National University, then remarked: “Yeah, but, no, no that’s right. I, I, I take that, senator. Uh, I, uh, nah, that’s a, I understand that.”

You're talking about providers. What does that have to do with an arbitrary minimum 50 per cent cut in community participation support that affects participants and which alone is said to save $13.2 billion? No reason given other than the minister thinks that is too much leaving the house.

The concern here is that the agency is not being upfront with participants who may well be signing over their NDIS records to train an algorithm that will end up cutting their funding. Consent forms don't specify what 'analysis' or 'research' is being done.
