Suspect City v PL APT 2 is purely because the follow on arbitration panel from City v PL APT 1 indicated it did not have jurisdiction to consider the question of whether the November amendments were lawful ie that it needed a fresh case.

The PL's Arbitral Tribunal has been asked questions that are clearly relevant to the rules going forward. Even on City’s case it is not true that “no financial rules” are in place in the interim - both PSR (currently ex shareholder loan interest adjustments) and related party rules *are* in place.
