I hesitate to do this. In her defense, California is the hardest bar exam in the country. I wonder where in her class at Pepperdine she finished? 90% of Pepperdine grads pass the bar on the first try. So she may well be the bottom 10% of her class.

THE LEVERAGE is a novel built partly from the documented record, and the seam between the two is meant to be visible. The history in it is real. Where a real person speaks, the words are theirs. Everything load-bearing is logged, with its source, at theleveragebook.net/register

The Leverage — Source Register

The unintended consequence might be that public executions might be the best way to turn the American public away from the death penalty (especially if the screw it up).

The electorate is four groups. Democrats. Republicans. MAGA. and the non partisans. Republicans and non partisans are reachable. I agree MAGA are hopeless. Democrats alone can not win. MAGA alone can not win. Actual GOP can not win. Non partisans can not win. You need 2 or 3 of these groups.

How did that work out last time? Two impeachments. Two trials. Two acquittals. His base sees impeachment acquittal as an example the mendacity of the democrats. It activates them. You need to do the opposite.

We need to focus on 2028. The only way he's leaving before then is if he dies. Win the senate in November. Stop his judicial nominations to stop the bleeding. Everything else is a distraction.

And if the final vote is 66 to convict then he will STILL be acquitted. And it won't be close to that. Maybe we get 51 or 52 votes to convict. Straight party lines, we'll lose Fetterman. Then what?

Erik @sisyph.us · 07/10/2026
If you don't have 67 votes to convict then what's the point? A big part of the reason he won in 2024 is that he got acquitted twice. It strengthened him politically.

There is no definition of "high crimes and misdemeanors", it's whatever congress decides it is. The GOP never had 67 votes to convict in the senate and they knew politically an impeachment acquittal is a loser so they did not bother. Hopefully the dems figure that out.

Being left handed is impeachable if you can convince half of the House and 67 senators it is. If you can't convince them, then nothing gets you to impeachment and removal.

Erik @sisyph.us · 07/10/2026
You need 67 votes in the senate. Good luck. Not happening.

Does that mean the next President can do very bad things to you? SCOTUS disagrees, at least as far as Biden and Obama are concerned.

There's not much the democrats can do to de-trumpify the executive with one or both chambers of congress. There's essentially nothing other than stop the bleeding by not confirming nominees. They need to win the WH in 2028.

The only "locking up" capability congress has is inherent contempt. That can only lock people up until the end of the session. Even then the DOJ will probably just refuse to lock them up. So I guess we have the Sgt at Arms set up a jail in the capitol?

You need both houses of congress, you probably need to kill the filibuster in the senate, and you need the presidency. It's just a statute, like any other law. Of course, they can just switch it back (or add even more) when they are in power.

To change the size of the court you need to pass a statute. You need it to pass the house, you need it to pass the senate, you need the President to sign the law (or you need to pass in congress with enough votes to override the veto). FDR had all three and still could not get it done.

Democrats are not the problem. They will largely come around. Getting purple state independents to vote for candidates who self identify as socialists is the challenge.
