Sharon Brett @sharonbrett.bsky.social · 07/10/2026This is my approach in fed courts. I also try to get them to see how/when justices are consistent in their approach over time/context (eg Scalia’s approach to standing) vs ends-focused. My own views are obvious based on my priors but I don’t discuss them explicitly b/c they’re not the point. 030

Sharon Brett @sharonbrett.bsky.social · 27/09/2026Oh, no, this is entirely Michigan football related. 😂 they have been giving me a hard time all semester! 110
Sharon Brett @sharonbrett.bsky.social · 27/09/2026Absolutely dreading facing my students on Monday. 130
Sharon Brett @sharonbrett.bsky.social · 22/09/2026Haha yes, this was more of a rhetorical question. 010
Sharon Brett @sharonbrett.bsky.social · 22/09/2026The remaining 2% goes to people who convinced me to finally go to law school and @jdmortenson.bsky.social who convinced me not to drop out. 😂 110
Sharon Brett @sharonbrett.bsky.social · 22/09/2026I’m….. not. So you’ll have to give me your takes. But the original is like 98% responsible for my entire career trajectory. 100
Sharon Brett @sharonbrett.bsky.social · 22/09/2026Speaking of did you hear Netflix is redoing the Stanford prison experiment? 000
Sharon Brett @sharonbrett.bsky.social · 22/09/2026This is going to be the most philosophical/religion-coded thing I’ve ever said on here, but I think there’s something endemic about sitting in judgment, the power imbalance it creates, and what that does to systems/ institutions/people over time. 130
Sharon Brett @sharonbrett.bsky.social · 22/09/2026Tomorrow in civ pro when I (as usual) start the lecture by showing where we’re at in my handy “lifecycle of a civil case” slide, do I just X stuff out and skip us to the end? Is that how this works now? 370
Sharon Brett @sharonbrett.bsky.social · 22/09/2026In addition to no jurisdiction in what universe is it procedurally proper for an circuit court to deny an appeal from a PI and remand with instructions to skip about 45 steps and ope just go right ahead and enter a permanent injunction? 181
Sharon Brett @sharonbrett.bsky.social · 22/09/2026Interesting. I’m not sure I’m with you, but not because of any big defense of the federal bench. I think I see different, yet still important, downsides to your approach. 000
Sharon Brett @sharonbrett.bsky.social · 22/09/2026Once again…. For the eleventh billion time this semester…. *screaming in fed courts/civ pro* 040
Sharon Brett @sharonbrett.bsky.social · 22/09/2026I mean this very sincerely - but what is it about administrative tribunals that makes you think they’d be a) better suited, b) not fall victim the same ills as what you set out to destroy? In other words, when we follow it all the way down, is it a judiciary issue, or an *adjudication* issue? 010
Sharon Brett @sharonbrett.bsky.social · 20/09/2026As an undergrad of a certain generation my excitement over Tommy carr’s touchdown drive was hard to contain. The 10 year old was like, “bruh what’s the big deal” and then I just felt old. 120
Sharon Brett @sharonbrett.bsky.social · 10/09/2026Indeed, if you wanted to go hard and non neutral, you could do as @equalityalec.bsky.social does and just call it “the criminal injustice system” or better yet “the punishment bureaucracy.” Criminal legal system is about as neutral as it gets. 020
Sharon Brett @sharonbrett.bsky.social · 09/09/2026*plz check on your friends teaching election law and fed courts this fall* 031
Sharon Brett @sharonbrett.bsky.social · 09/09/2026Just once, for one single solitary day, I would like to be able to stick to my fed courts syllabus this semester without deviating for breaking news examples. 011
Sharon Brett @sharonbrett.bsky.social · 03/09/2026What a day to be talking about Supreme Court reform in Fed Courts! 0173
Sharon Brett @sharonbrett.bsky.social · 31/08/2026Understood. I see your point! I’m just not sure I’m fully convinced on that one part. I may get there - and certainly agree on many of your other points - so appreciate the engagement. 020
Sharon Brett @sharonbrett.bsky.social · 31/08/2026Yes. I think you also talked about this in the HLR foreword? All very helpful in my own thinking. 000
Sharon Brett @sharonbrett.bsky.social · 31/08/2026That’s fair. I’ll think on that some more. I wonder if joining one opinion without comment can suggest a real realignment, or if it’s just an outlier, but you’ve given me something to ponder more. Thanks! 100
Sharon Brett @sharonbrett.bsky.social · 31/08/2026Super pumped to work yet another standing decision from the emergency docket into fed courts class in two weeks. 010
Sharon Brett @sharonbrett.bsky.social · 31/08/2026I’ve been thinking a lot about the new line of precedent emerging that anytime the executive/leg is prohibited from carrying out their prerogatives that it is “irreparably harmed.” 1141
Sharon Brett @sharonbrett.bsky.social · 31/08/2026Anyway, just a random thought as I’ve been reflecting on the piece. 100
Sharon Brett @sharonbrett.bsky.social · 31/08/2026In other words, would you say it’s a true realignment, or is it instead the maj. abandoning originalism when convenient and the dissenters simply pointing that out? I don’t really think they are subscribing to originalism as much as saying, if you were *really* doing originalism, it’d result in x. 110
Sharon Brett @sharonbrett.bsky.social · 31/08/2026Richard, I enjoyed your term roundup scotusblog piece. On the originalism point, though, I’ve been wondering whether the liberals are actually realigning, or just using the majority’s previously preferred method to point out the majority’s hypocrisy. 110
Sharon Brett @sharonbrett.bsky.social · 28/08/2026Civ pro AND fed courts this semester. Which means a lot of waiving my hands around and my watch asking me if I’m doing an elliptical workout (year 3 day 1 in the books ✅) 1180
