It was tough to imagine full implementation on the timeline given — emailed at 6:46p Sunday of a holiday weekend and seeking nationwide action as to that evening — but, generally speaking, counsel is going to want to show the judge how they tried to comply. This, with a throwaway apology, is weak.

I don't know what happens as to the Sunday night ads, but it's hard to say that DOJ made even reasonable efforts to ensure timely implementation of the TRO — which included language that the defendants were to "immediately" inform the vendor and were also to cancel the October 11 ad placements.
ORDERED that Defendants shall immediately provide a copy of this order to LMD, under Federal Rule of Civil Procedure 65(d)(2)(C), and that LMD, as a contractor that is in
active concert and participation with Defendants, is enjoined from continuing to run or place the challenged advertisements; and it is furtherORDERED that Defendants shall cancel or cause to be cancelled any slot, placement, reservation, or arrangement for the airing or dissemination of the challenged advertisements, including those placements for the evening of October 11, 2026;

After plaintiffs noted that ads continued running last night — storage.courtlistener.com/recap/gov.us... — DOJ, in its status report, says the gov't is now in compliance. As to last night, they say, essentially, "We tried, but DHS didn't check their email." storage.courtlistener.com/recap/gov.us...
As Your Honor is aware, the Court emailed the TRO to the parties yesterday at 6:46 p.m.
Counsel for the Government emailed the TRO to agency counsel at 7:58 p.m. Agency counsel did not become aware of Government counsel's email until this morning. The undersigned apologizes to the Court and the plaintiffs. As required, DHS provided the TRO to the vendor, Lepugh, Inc. doing business as LMD Agency, Inc. ("LMD"), this morning.
The Government is in compliance with the TRO. In addition to the above, the purchase order entered into on or about September 20, 2026 between U.S. Customs Border Protection ("СВ") and LMD (the "September 20, 2026 purchase order") is stayed, including all future payments made thereunder; the Office of Management and Budget's apportionment of $20 million to fund the development, creation, and/or airing of the advertisements covered by the September 20, 2026 purchase order, including but not limited to The Country He Loves, Celebrating the Enduring Spirit, Final Battle, To the Great Proud People of Iran, and Maduro (collectively, "the challenged advertisements") is stayed; Defendants understand that they are enjoined from using, disbursing, or transferring funds appropriated to the Department of Homeland Security to develop, create, disseminate, place, distribute, publish, or air the challenged advertisements; Defendants understand that they shall cancel or cause to be cancelled any slot, placement, reservation, or arrangement for the airing or dissemination of the challenged advertisements; Defendants understand that they shall not enter into, renew, or expand any agreement authorizing the development, creation, dissemination, placement, or airing of the challenged advertisements; and Defendants provided a copy of the TRO to LMD and LMD has been notified that it is enjoined from continuing to run or place the challenged advertisements.

October 13, 2026 and such conference is adjourned. The Court finds that (1) the present motion
is not moot, (2) there is standing to proceed, and (3) the moving Plaintiffs have demonstrated that they are likely to succeed on the merits, will suffer irreparable harm in the absence of an injunction, the balance of the equities tips in their favor, and an injunction serves the public interest. A full opinion shall follow shortly. Therefore, the Court GRANTS the moving Plaintiffs' motion, and IT IS HEREBY:
ORDERED that under 5 U.S.C. § 705, the purchase order entered into on or about September 20, 2026 between Customs Border Protection ("CBP") and Lepugh, Inc., doing business as LMD Agency, Inc., ("LMD") ("September 20, 2026 purchase order") is stayed, including all future payments made thereunder; it is further

ORDERED that Defendants are enjoined from using, disbursing, or transferring funds appropriated to the Department of Homeland Security ("DHS") to develop, create, disseminate, place, distribute, publish, or air the challenged advertisements; and it is further
ORDERED that Defendants shall cancel or cause to be cancelled any slot, placement, reservation, or arrangement for the airing or dissemination of the challenged advertisements,
including those placements for the evening of October 11, 2026;
ORDERED that Defendants shall not enter into, renew, or expand any agreement authorizing the development, creation, dissemination, placement, or airing of the challenged
advertisements; and it is furtherORDERED that the foregoing instructions bind Defendants' officers, agents, employees, contractors, and anyone acting in concert with them. See Fed. R. Civ. P. 65(d)(2).
ORDERED that Defendants shall immediately provide a copy of this order to LMD,
under Federal Rule of Civil Procedure 65(d)(2)(C), and that LMD, as a contractor that is in active concert and participation with Defendants, is enjoined from continuing to run or place the
challenged advertisements; and it is further
ORDERED that Defendants will file a status report within 24 hours of the entry of this temporary restraining order and Section 705 stay, confirming compliance with this Order; and it
is further
ORDERED that this Order shall remain in effect until 14 days from today, subject to an extension of this Court; and it is further
ORDERED that, in the Court's discretion, Plaintiffs shall not be required to post a bond.Case 1:26-cv-08882-JLR Document 41 Filed 10/11/26 Page 4 of 4
This Order shall be effective as of 6:45 p.m. on October 11, 2026 and the Clerk of Court
is respectfully requested to close the motion at Dkt. 25. The Court will reschedule the October
13, 2026 conference to discuss next steps in this matter.

Here is DOJ's response in the DNC case: storage.courtlistener.com/recap/gov.us... That said, DOJ's merits defense is primarily a structural one about whether this is final agency action and whether the right parties are sued. The actual "merits" meat is embarrassingly weak:
Here, Plaintiff contends that the ads are contrary to the prohibition on using federal funds
"for publicity or propaganda purposes," Pl.'s Br. at 17 (citing Pub. L. No. 119-75, § 718, 140 Stat. at 495). But the Act does not define "publicity" or "propaganda." See Principles of Federal Appropriations Law at 3-281 ("[T]here is no definition of either term."); see also id. at 3-282 ("[T]he prohibitions themselves provide little definitional guidance as to what specific activities are publicity or propaganda").
And "[i]n construing and applying a publicity or propaganda provision," id. at 3-281, it is necessary to "achieve a delicate balance between competing interests." Id. On the one hand, the Executive "has a legitimate right to explain and defend its policies and respond to attacks on th[ose]
policies]." Id. at 3-294. So "[t]o restrict all materials that have some political content or express
support of an Administration's policies would significantly curtail th[at] recognized and legitimate exercise of the Administration's authority to inform the public of its policies, to justify its policies and to rebut attacks on its policies." Id. at 3-296 (citation omitted). It is also "important for the public to understand the philosophical underpinnings of the policies advanced by elected officialsand their staff in order for the public to evaluate and form opinions on those policies." Id. (citation omitted). On the other hand, the statute must mean something, so if the activity in question is
"completely devoid of any connection with official functions," then the use of appropriated funds will be improper. Id. at 3-294 (citation omitted).
In light of the foregoing considerations, Plaintiff is unlikely to show that the statute provides a "clear and specific statutory mandate," Fed. Express Corp., 39 F. 4th at 766, that would justify ultra vires review.

NEW: The TRO request reply from the plaintiffs in the S.D.N.Y. challenge to the pro-Trump ads echoes some of what I was explaining overnight. It is, independent of that, fire in other ways, too — including asking the court to rule today on the briefing. storage.courtlistener.com/recap/gov.us...
INTRODUCTION
Defendants admit that appropriated funds were used to pay for political ads and do not dispute
that this use of taxpayer money is unlawful. Instead, much of Defendants’ opposition boils down
to a single premise: it is too late for the Court to act. That is not because Defendants have stopped
airing the ads. Indeed, Defendants assert—boldly, given their failure to defend the ads on the
merits—that ads will continue to air today, including during evening programming that will attract
millions of viewers. Rather, Defendants say there is nothing for this Court to do because the
Defendants will stop airing the ads soon—presumably by the time Defendants believe the Court
can rule on the motion. That attempt to run out the clock does not cut against issuing a TRO and a
Section 705 stay; it shows why the Court should grant relief today.
