Rule 6(e) is pretty clear on this point. MUST BE RECORDED. And govt would have to show an “unintentional failure” to maintain the validity of the indictment.

(e) RECORDINg ANd DIScloSing THe PRoCEEdINgS.
(1) Recording the Proceedings. Except while the grand jury is deliberating or voting, all proceedings must be recorded by a court reporter or by a suitable recording device. But the validity of a prosecution is not affected by the unintentional failure to make a recording. Unless the court orders otherwise, an attorney for the government will retain control of the recording, the reporter's notes, and any transcript prepared from those notes.

The USAO then takes the indictment from the LOCAL grand jury on a FEDERAL charge to FEDERAL court. USAO: "Hi, here's indictment to return. Just sign real quick, thx." Magistrate: <reviewing doc> "um, wtf?" He writes, "At a minimum, this is very unseemly; more than likely, it is unlawful." /3

In this case, a federal grand jury refused to indict on gun possession charges. Undeterred, DC USAO goes to a LOCAL grand jury in DC (local) Superior Court and get the LOCAL GJ to indict on FEDERAL charge. Superior Ct has separate grand jury process from DDC. They are different courts! /2

I always thought that a “swing” happened if the bat crossed the plate before the batter could check it. Turns out it has to do with the angle of the bat.
