Burnham's education reforms proposal has reminded me of Peter Mandler's "The Crisis of the Meritocracy: Britain's Transition to Mass Education since the Second World War" & one of its key arguments: the expansion of academic education was bottom-up demand, not top-down imposition.

Great to write this article (to be published by European Human Rights Law Review) with @anuragdeb.bsky.social & @lewisgrahamlaw.bsky.social. Applying settled principles of human rights law, we think Higgs is wrong. We also found no justification for it in EU/retained EU law – the opposite, in fact.

A reminder from the Court of Appeal that (a) whilst human rights cases can raise knotty points of law, human rights cases can and do turn on disputed facts and (b) if you fail to challenge another party's evidence on those facts, it's going to be difficult to unpick that mistake on appeal

Re Higgs v Farmor's School, it's somewhat odd how at [68] Underhill LJ states that in Page v NHS the Court held "there had been an interference with his right to manifest his beliefs under article 9", citing [52]-[63] of Page, when at [51] of Page Underhill LJ says the CA did not determine the issue
