Yea, try yelling fire when it's a false alarm.

And, you proved my point. The Constitution is written for the rich and their exploitation of the People. The People pay, as in Love Canal; neighborhoods downwind of refineries in Louisiana. Workers, like me, suffering from lung exposure. The law is rotten. Start anew.

Oh, try yelling fire in a crowded theater or talk about revolution in a check-out line: see attached. We should regulate press speech but only repeated lies discovered by fact-checking. Our law is based on England: this is how they deal with --- it's regulated.

Oh, really. You're not a journalist. So, you don't know how tough it is to get a fraud past a team of editors with honest press. Obviously, we keep Sullivan. But, so many stories have been proven false and the editors knew about it. See: NY Post on Hunter Biden.

I did read them and I am unconvinced. He is talking about fixed law, which Trump proved doesn't work. I am talking about thinking anew. Surely, you don't consider the Constitution an act of God? The framers only thought of themselves in the 18th century. Then, the law was corrupted.

An independent DOJ is supposed to rule on logic. And, safeguards could be built in: Congress, the President, lower courts, and a new de-throned upper court. Trust engineers to build a bridge but not journalists to ID lies for licensing status?

Is it laziness? The law is a mess. Much of my career was spent going into ancient plant and making them run. You don't strike me as a slouch who says it's too hard. Surely, we can do better than the framers. Not sacrilege.

Maybe because I spent an engineering career finding and fixing problems people ignored or didn't discover themselves. In school, I was the only one of my class to solve a tough problem --- one even the professor thought impossible.

We regulate water, air, stocks, products --- or at least, government is supposed to --- but doesn't because of changes to law: to make the rich, richer and leave us with the bill. We do regulate speech. So, why can't a lie be forced off the air?

Or a convention. Such a device erases parts of history touched by SCOTUS. It is fixing the clock and handing it back to the People, scratched but keeping time again.

Okay, you're a lawyer. You claim that the world is yours because you can explain what lettuce is in 1000 words what a scientist can explain in a short paragraph. You can't argue the case that the law has worked. It has failed to contain Koch/Trump.

Oh, pardon me. Labels are a lazy man's tool.
100
Me at work @rocketmansparty.bsky.social · 17h
As a lawyer, I'm sure you've seen many lies. Labels are easy. I still stand by what I think, about the law, about journalism. The law has failed because, in this system, it protects the rich against the weak. How else has the Epstein class survived?
100
Me at work @rocketmansparty.bsky.social · 17h
Not if SCOTUS is around! Their history isn't merely to clarify the law -- instead, it seems to do the opposite, then make it unworkable. No, I hope we can agree that the system doesn't work for most people -- who pay taxes and are the blood of this country.

In my own area of expertise, journalism and STEM, I reserve the right to be skeptical. In areas of public policy, I suggest that if things worked so well, we wouldn't be in this mess. Since this is the area of the law, I point out how badly they're managing it.

The past isn't the point. The Constitution has always been for the rich, against the People. Look at the Senate. Look at SCOTUS. Always conservative. As a lawyer, you can see how abnormal this is! We need a new system, one that relies on more than the law.

Me at work @rocketmansparty.bsky.social · 18h
Sure, SCOTUS damage can be redone, but by the time Congress can act, they will have broken something else. It took SCOTUS only 5 yrs. to gut the Sherman Anti-Trust Act. TR extended executive powers to use it on Standard. Now, we're stuck with the executive powers.

Me at work @rocketmansparty.bsky.social · 18h
I disagree. People are allowed to lie. They should not be allowed to publish lies identified by fact-checking. The press is not a person; like corporations, they should have no rights to speak lies freely. Journalism is strict. www.youtube.com/watch?v=cpXK...

Yes, let us not rewrite the 1st but the 4th, 5th, 6th, and many others must be restored from the damage done by SCOTUS. I hope you can agree that Alito & the other 5 must see the docket.

I love the 1st Amendment. Without it, the Constitution is merely a chain that binds the People in servitude to the framers (the rich) forever. I would burn it to ask were it not for the Bill of Rights.
100
Me at work @rocketmansparty.bsky.social · 18h
We can come to reasonable terms. I am merely suggesting that a clock is broken but you insist that still reads the time. Anyone can see this but nobody can fix it until we have a look and discuss solutions, which require everyone, not just lawyers.
200
Me at work @rocketmansparty.bsky.social · 18h
I don't think you understand how rigorous fact-checking is in science and journalism, 2 areas I am familiar with. Until 2023 (SCOTUS), the law left details to experts rather than assume lawyers knew everything. Koch pushed this case through to kill regulation --- we need that.
100
Me at work @rocketmansparty.bsky.social · 18h
Maybe there are things in the old law that must be abandoned or re-thought to make progress?

Me at work @rocketmansparty.bsky.social · 18h
You can no more explain the legal nuances to me than I can explain mathematics to you. Still, I think we can agree that we are in new territory; the tools of the past have failed; and we are stuck with Einstein's argument.

Me at work @rocketmansparty.bsky.social · 18h
You're a lawyer. I am an engineer/PT journalist. A lie can be defined in an expertise, like journalism or science. We don't need lawyers to define it only convert it into legal actions, such as revocation of a license to spread lies caught by fact-checking.

I put this together months ago based on past readings and what I have observed about corporate democrats and republicans. I am closer to the DSA now than the democrats:

Gee, we are limited by what can be presented in a Twitter-style format. Besides, a reboot of the Constitution would address the details. Can you explain why the 1st Amendment is affected? I don't see that.

Me at work @rocketmansparty.bsky.social · 18h
Don't get lost in the weeds! We need a structure that is really independent from politics. Make the law as boring as being a librarian -- which is how the founders looked at it until Marshall.

1921: Dillon v Glass- set a time limit on amendments. (SCOTUS). Never challenged. We can't wait to fight another battle with SCOTUS: it must be rebuilt to make it non-political.

The constitution was never meant for our time. It was written to keep the rich powerful. Example: SCOTUS. It has undone virtually all laws supporting the people: recently, Roe, Civil Rights, 4th, 5th, 1st amendments. I wrote on this a decade ago:

A new constitution is needed. Include revocation of SCOTUS ruling on agencies (2024). We used to leave details to agencies but SCOTUS gave judges the challenge of understanding details of science that I spent decades fully learning.

No, the board presents to the DOJ, assuming we make it independent. This only works with independent DOJ: 1. 3 lies/yr. - disclaimer. 2. 3 more lies/yr. - banned for a month. 3. 3 more lies/yr. - license revoked.

Sorry, COVID/flue shots. The constitution has failed us. Jefferson: "the earth belongs always to the living generation" and that dead generations hold no natural rights or binding authority over it..." He said every 19 yrs.: we are overdue.

No, I want SCOTUS to stand trial for the ill-gotten gains like the rest of us would. Trump stress-tested the constitution. We need a 2nd edition:

Oh, yes, remember the first days of COVID: * Trump botched isolation, ignoring China's advice. * Then, he made sure he & his had protections while the rest of us died. * Then, Trump, Inc., republicans, & oligarchs figured out how to rob COVID relief funds.

We've seen what Trump/Koch have planned for us. When Nixon helped overthrow the New Deal gov. of Chile, Koch experimented with privatizing SS; when he failed, Koch expunged it from the internet. This is what Koch's Project 2025 has in store for SS:
