4/ Using a disability reproductive justice framework, I argue that antidiscrimination law is necessary but not enough. Reproductive freedom means more than preserving ART in the abstract. It requires meaningful access for disabled people.

3/ My article asks what access to assisted reproduction actually looks like for disabled people. I examine barriers created by fertility clinics, insurers, and parentage law, and how those institutions shape who gets to form a family.

2/ Assisted reproduction is getting more public attention, from AOC sharing her experience freezing her eggs to growing legal attacks on IVF. But disabled people remain largely absent from these conversations.

A comment from Alison Barkoff, the Biden administration’s assistant secretary for aging and George Washington University health law and policy professor. “I think this is sending a message that this isn’t a critical issue, that maybe parents – people with disabilities – don’t need this kind of support and advocacy and research... But people with disabilities face so much discrimination as parents. It is a huge gap that no other entity or funding source can fill.”A comment from Cathy Haarstad, board president of the Maryland-based Association for Successful Parenting: “The cost of a foster care placement currently averages $58,000 per child per year... government investment in research that benefits parents with disabilities, whose children often end up in foster care due to systemic bias, would be a good investment of taxpayer dollars.” Then, a comment from Kimberly Tissot, a cancer survivor, amputee and disability rights activist who leads the nonprofit Able South Carolina: ““[Cancelling the grant] will destroy families. This was a significantly bad move... parents with disabilities are overrepresented in the child welfare system and nobody else talks about it.”

Disabled people face barriers to marriage through guardianship restrictions, benefit penalties, institutional rules, and stigma. These structures turn a constitutional right into a conditional one.

Ultimately, I advocate for a more holistic, intersectional approach to reproductive justice—one that fully includes and empowers the disability community. This requires robust coalition-building between disability rights and reproductive justice movements.

I explore constitutional arguments, even under rational basis review, to demonstrate that these bans lack legitimate governmental interest and contradict core disability rights principles.

My article argues that these bans not only exacerbate existing healthcare barriers for disabled people but also perpetuate discrimination by undermining principles of bodily autonomy and self-determination central to disability rights.

Post-Dobbs, many states have enacted restrictive abortion laws with vague health exceptions. These laws often ignore the complex realities faced by disabled people, particularly regarding mental health and medical emergencies.
