I am making no value judgments about any of the accounts on the list! It is purely to reduce some of the friction around unwanted bot contact!

I may not yet have worked out the totality of edge cases. I am generally erring on the side of listing when in doubt, as opposed to my usual practice of erring on the side of not listing. I am using subjective judgement in determining whether unlabeled accounts are generated or agentic.

I guess it's as good a time as any to announce the new moderation list I have: "Silence, robot", for bots, LLMs, and agents that speak to you without all parties who will receive the notification having solicited the speech: bsky.app/profile/raha...

I wildly disagree with Paxton's holding that age verification mandate is only an incidental burden on adults, for many reasons I've already explained, but even so, it is very clear that the *only* time you can apply intermediate scrutiny to age verification mandates--
120
rahaeli @rahaeli.bsky.social · 2h
--which the 11th badly misinterprets here to permit intermediate scrutiny of age verification mandates for material that is not obscene as to minors, when it states the only reason strict scrutiny did not apply is that the speech being regulated is obscene as to minors but not as to adults.

We can reconvene once you've read them all and gotten up to speed for the 501-level discussion I'm trying to have and not the 101-level discussion you keep trying to redirect to. Holding it purely to cases I have not been a part of and am not cited in, that list is:
120
rahaeli @rahaeli.bsky.social · 2h
The "asserting you did not say what you did, in fact, say" is also a little irritating! So at this point I am dropping you the mother of all string cites to show that my arguments are, in fact, grounded thoroughly in both 50 years of 1A and Internet jurisprudence *and* the most recent developments.
110
rahaeli @rahaeli.bsky.social · 2h
I will confess to frustration at this point, because I have repeatedly cited authorities for my arguments that you have not read, but feel confident dismissing without providing alternative authorities to justify why you think they're inapposite.
110
rahaeli @rahaeli.bsky.social · 7h
Have you read the proceedings in Netchoice v Bonta (2025) yet?
130
rahaeli @rahaeli.bsky.social · 7h
And degree of scrutiny is irrelevant in the discussion we are actually having, because as I have repeatedly shown you, this is a content-based and speaker-based restriction, not a TPM or commercial speech restriction. Any court that finds anything other than strict scrutiny applies is simply wrong.

rahaeli @rahaeli.bsky.social · 7h
Maybe I got the idea that you think timeline sorting and content selection algorithms aren't speech when you said you don't think timeline sorting and content selection algorithms are speech and asked me for citations? Because that's what "not going to get into" means.

If a contract cannot be formed in those circumstances, but HB3 requires a site to age-verify a user and impose the 2h time limit anyway, the law *cannot* be regulating the circumstances under which a minor is able to form a contract. It is a pretextual restriction on access to speech.
051
rahaeli @rahaeli.bsky.social · 12h
The 11th holds that "browsewrap" ToS formation is not binding and therefore a contract is not formed, and they class ToS assent that is *far* more affirmative than "opened a link to read a page with cookies enabled" as "browsewrap".
150
rahaeli @rahaeli.bsky.social · 12h
--that the law also applies to users who have not registered an account, to the degree the site is able to uniquely identify them, which directly contradicts prevailing 11th circuit precedent regarding contract formation as applied to a website terms of service. (See, eg, Tejon v. Zeus Networks.)
130
rahaeli @rahaeli.bsky.social · 12h
Again: both you and the 11th Circuit are getting this analysis wrong because you both are accepting Florida's pretextual lie that they are attempting to regulate commercial transactions. This is, blatantly and obviously, pretextual, which is easily discernible from the fact--
140
rahaeli @rahaeli.bsky.social · 12h
Limiting minors to 2 hours a day of access forces the site to adopt and communicate the state's position that social media is harmful to minors. This statement is neither "purely factual" nor "uncontroversial" (because, as I have shown you the citations for, it isn't true).
250
rahaeli @rahaeli.bsky.social · 12h
Moody's holding that personalized content discovery and timeline sorting is an expressive act of editorial discretion akin to Tornillo or Hurley means that the Zauderer standard applies, and sites cannot be forced to convey a message unless it is "purely factual and uncontroversial".
130
rahaeli @rahaeli.bsky.social · 12h
The fact the court declined to opine on what level of scrutiny applies is irrelevant. I said the decision addressed whether personalized content discovery and timeline sorting is speech; you said it didn't. The screenshots clearly state that it is.
250
rahaeli @rahaeli.bsky.social · 12h
There is no question mark in my post.
110
rahaeli @rahaeli.bsky.social · 12h
The substantive holding is indisputable: Zauderer, Tornillo, Turner I, and Hurley are still apposite to algorithmic timeline curation and content injection, and "the government may not [...] alter a private speaker's own editorial choices".
240
rahaeli @rahaeli.bsky.social · 12h
And you want the proposition "algorithmic timeline curation and content discovery injection is an act of speech, and subject to the precedents regarding the 1A protection of editorial discretion" in the decision itself and not just the syllabus? It's there, too.
The list could continue for a while. The point of it is not that the speech environment created by Texas's law is worse than the ones to which the major platforms aspire on their main feeds. The point is just that Texas's law profoundly alters the platforms' choices about the views they will, and will not, convey.

And we have time and again held that type of regulation to interfere with protected speech. Like the editors, cable (con't in next screenshot)operators, and parade organizers this Court has previously considered, the major social-media platforms are in the business, when curating their feeds, of combining "multi-farious voices" to create a distinctive expressive offering.
Hurley, 515 U.S., at 569. The individual messages may originate with third parties, but the larger offering is the platform's. It is the product of a wealth of choices about whether and, if so, how-to convey posts having a certain content or viewpoint. Those choices rest on a set of beliefs about which messages are appropriate and which are not (or which are more appropriate and which less so). And in the aggregate they give the feed a particular expressive quality.
140
rahaeli @rahaeli.bsky.social · 12h
It specifically states that algorithmic content selection based on the prediction that a particular user will be interested in a particular piece of content is speech, and specifically an exercise of editorial discretion, which is the proposition you were stating the decision did not contain.

Yeah, I know I will be able to someday face Bast with a clear conscience and the absolute conviction that I gave her the best retirement years she could possibly dream of! I just want my poor little old lady to be happy (and a little less scraggly-furred, heh)
0110
rahaeli @rahaeli.bsky.social · 12h
I am absolutely confident that we're doing the best we can for her! She's still wildly happy, and that's all I want for her.

rahaeli @rahaeli.bsky.social · 12h
When the time comes, whenever that may be, I will be able to face Bast in good conscience knowing that I spoiled the shit out of her, heh. It's just tough because we have another cat with small-cell lymphoma (responding to treatment, but still) and so I'm already braced for the next year or so.

rahaeli @rahaeli.bsky.social · 12h
I'm so sorry for your loss. It's incredibly difficult to accept that sometimes the kindest thing to do is to do nothing but make the remaining time as full and painless as you can.
060
rahaeli @rahaeli.bsky.social · 12h
And obviously I hope that life is longer rather than shorter, but I've never had a cat who didn't tell me clear as day the instant they were done.
1440
rahaeli @rahaeli.bsky.social · 12h
So now that I'm confident, we go to the clinical goals of "put more weight back on her" and "at the first sign of pain, begin all palliative measures she'll accept", and let her guide what treatments she's willing to tolerate for the rest of her pampered princess life with me!
1420
rahaeli @rahaeli.bsky.social · 12h
We were chasing the diagnostic options because I wanted to be absolutely certain that I wasn't leaving an easy-to-treat illness unfound; the vet dentist told us exactly what we needed to know, which was that he could rule out all the easy-treatment explanations without further diagnostics.
1180
rahaeli @rahaeli.bsky.social · 12h
Yeah. I choose vets who agree with my fundamental philosophy, which is that treatment must optimize for quality of life and not simply length of life, and that any treatment that extends a cat's life but makes the extra time stressful and miserable is not a treatment I am interested in pursuing.

She used to love being brushed but since she lost so much weight, I think the brush is uncomfortable going over her joints, and she really doesn't like when I gently try to pick the mats apart with my fingernails because it pulls too much, so I think the shave might be inevitable.

rahaeli @rahaeli.bsky.social · 13h
My poor stinky scraggly old lady cat still loves me (and vice versa), though, and she's clearly not suffering, so everyone cross your fingers for the meds to work. And for me to be able to untangle (or shave) the matted fur without bloodshed.

(She absolutely will not let me pill her, turns her nose up at pill pockets and the like, and the meds can't be crushed and mixed into wet food, so transdermal it is, and whatever dose I can get into her will have to do. Her majesty's bodily autonomy is paramount and defended with knives.)

--and offering palliative care if she progresses to the point where she's showing signs of actual pain and not just "I want my human to rub this lump while I drool on her, because it's annoying me and the pressure feels good". So I get to do thyroid meds ear rubs!

(Subtext: I think he thinks it's probably some form of bone cancer, not osteomyelitis the way the vet thought , since the antibiotics didn't clear it up.) He basically recommended treating the thyroid condition more aggressively so we can feed her whatever she'll eat and not just the thyroid food--
