Cardone asked the audience to remain silent while she read her motion from the bench. In the gallery, Big Bend residents began to weep as they realized that construction will come to a halt. Once outside, supporters headed across the street to The Tap, in true El Paso fashion.

It was an emotional day at the courthouse, as witnesses shared how border wall construction is already impacting their lives, property and livelihoods. One witness said the wilderness of Big Bend saved his life.

The lawsuit — brought by a river guide, a historic conservation organization and the Center for Biological Diversity — hinges on the sweeping waivers of dozens of laws the federal government issued earlier this year. Cardone's motion puts those waivers on hold while the case progresses.

Big news out of El Paso yesterday. I was fortunate to witness it. Judge Kathleen Cardone issued a temporary injunction that Customs and Border Protection must cease border wall construction in the Big Bend sector until it complies with applicable laws. insideclimatenews.org/news/0210202...

We also spoke about the rhetoric coming from his opponent. Bo French sent out an email comparing Rosenthal (the only Jewish member of the Texas House) to the Bolsheviks, which echoes the “Judeo-Bolshevism” conspiracy theory that the Nazis used to justify the Holocaust.

There were protests over the weekend in Camp East Montana in El Paso, which saw detainees break down the walls of pods. The protests were led by Venezuelans, who were demanding their deportations after months of being held in ICE detention. My story:

If you are not familiar with El Paso, this refinery is surrounded by homes. One of El Paso's best parks is a half mile away. The community is asking for transparency about the health risks they may face. I did not hear back from Marathon, nor the TCEQ, when I asked for comment today.

In the days to follow, the refinery released excess Carbon Monoxide, Hydrogen cyanide, Nitrogen Oxides, Particulate Matter, Sulfur dioxide, and Sulfuric acid.

Also today, Marathon updated its emissions event reports with TCEQ. According to the reports, the refinery released 1,3-BUTADIENE, 2-Butene-trans, 2-Methyl-1-butene, Cis-2-butene, Hydrogen Sulfide, Isobutane, Isobutene, Isopentane, isopentene, n-butane, n-pentane, Propane, and Propylene that night.

Since then, elected officials have sought more information from the company about what happened. They have come away empty-handed. Today, city council voted to request Texas Commission on Environmental Quality and the US Environmental Protection Agency hold a public meeting with Marathon.

During the night of August 4 and into the early morning hours of August 5, Marathon Petroleum Corporation's El Paso Refinery emitted thousands of pounds of hazardous compounds. Residents reported headaches, nausea and some left their homes to escape the fumes.

Troubling long-term dynamic here: as the rains increasingly fail, Texas cities will rely on fossil groundwater. But the groundwater — given that much of Texas spent its prehistoric seas, and sumps for rivers eroding ancient, geologically active mountains — has a *lot* of bad stuff in it.

That means residents drive 60 miles round trip to buy clean water in Fort Stockton. Meanwhile, Amazon is backing a nearby data center that will rely on what could be one of the biggest natural gas plants in the country. The developers didn't answer my questions about water.

Radium comes from naturally occurring deposits in the aquifer. Imperial is is one of dozens of Texas communities where drinking water exceeds the legal limit for radium. For small utilities the cost of finding an alternative water source or treating the water can be prohibitive.

Residents reported gas smells from the Marathon petroleum refinery in southeast El Paso on Tuesday night. According to reports filed with state regulators, the refinery released 8897 pounds of propylene, 19 pounds of 1,3-BUTADIENE, and 862 pounds of sulfur dioxide.
