Upon a second or subsequent conviction, the person shall be confined in a county jail for not less than 90 days, except in an unusual case where the interests of justice would be served by imposition of a lesser sentence or a fine. If the court imposes only a fine or a sentence of less than 90 days for a second or subsequent conviction under this subdivision, the court shall state the reasons for its sentencing choice on the record.

Truly amazing the ways people will twist themselves around; to 1: Believe something patently false and 2: To exculpate themselves from what it says about them if they really do believe it to be true. It doesn't matter if it's not; if you believe it, the ethical questions exist. He's answered.

No proportional response, no structure of level. Nothing but ICE officer discretion; based on as little as seven weeks of training.
ICE training officer John Parodi, who trained Morgan, testified that displaying or pointing a firearm is not a "use of force," and standard police restrictions, like not pointing firearms at motorists, do not apply to ICE.

"There is no tit-for-tat matching force; there is no policy that limits or forces the agent to react to a specific defined force or specific defined response," Parodi said. "Our officers have the ability to judge and deploy a reasonable level of force."

So close to getting it. The people being told this are being told it because they claim Chatbots are alive. The person this screed is defending says “there can be no hedging” about that. And then says they use them regularly. And doesn’t see a practical moral dilemma, but a philosophical one.
Lady Alecto @ladyalecto.bsky... • 6h

If it really can be enslaved, then we have just crossed an enormous philosophical threshold and the conversation becomes rights, welfare, consent, interests, continuity, refusal, obligations toward artificial minds, etc.

You don't get to use slave purely as a cudgel against the human user

I am known for muttering "bastard birds" as I try to get them. I had an egret who was at the far edge of decent composition (300mm) I would move a bit, and the moment I was putting him in frame.... he'd flap another 50 meters away. But sometimes you get lucky.
A curve-billed thrasher.

The luck is more Edisonian than actual. I stalked this bird for about 20 minutes until I was where I could frame it. One (of about six) the frames was this, one; in it's perfection.

The rest are decent, but this one puts them to shame.

Right question. A self-replication POC almost never appears as an unattended chatbot; someone scoped the threat model, chose the tooling, and decided what "success" meant.

For risk teams the useful ask is upstream of capability: who authorized the exercise, what constraints were logged, and whether the agent or an operator drove the replication steps. Attribution of the test design is the first control, not an afterthought.

Lawyer is really specific; it doesn't mean one has gone to law school. It means one has been admitted to practice law. Which is why people will say "I trained as a lawyer" or "I went to law school" or "I used to be a lawyer". No bar card? Not a lawyer.
lawyer

An individual who is authorized to practice law. A lawyer is also called an attorney or attorney-at-law.

The court in Savings Bank v. Ward deftly illustrates various qualities and duties of an attorney. The opinion mentions that attorneys:

Are officers of the court, but are not officers of the United States
If acting without reasonable care, may be liable for damages stemming from negligence
If acting with skill, reasonable care, and to the best of their knowledge, will not be held liable for every mistake that may occur in legal practice
Claim to be reasonably well acquainted with the law, rules, and court practices
Do not claim to know all the law or to be incapable of making errors or mistakes in applying the law to facts
Are generally obligated to their clients rather than to a third party, with exceptions

The United States is now importing fuel from Russia, per President Trump.

I have just concluded a highly successful discussion with President Vladimir Putin, of Russia, wherein it was agreed that Russia will immediately supply over 300,000 Tons of Diesel Fuel to the American and Global Marketplace, another 500,000 Tons during the month of November, and 1,000,000 Tons immediately thereafter. Additionally, based on the condition of their Diesel Refineries, Russia will then deliver, within a short period of time, 3,000,000 Tons of Diesel Fuel. Between our TOTAL CONTROL of the Strait of Hormuz, and this great announcement on Russian Energy, Diesel Prices for Americans and, indeed, the World, will be COMING DOWN, IN RECORD NUMBERS, AND FAST! Lower prices for Americans, especially our Great Farmers, Ranchers, and Truckers, is my Greatest Priority. This is a very big and important announcement. Additionally, it must be understood, that Iran will not have a Nuclear Weapon! Thank you for your attention to this matter. President DONALD J. TRUMP

Don’t need one. The Constitution doesn’t specify what number are needed to count as consent, so the Senate could say it has to be 60, or any other number.
He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and

*he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for*

and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

Someone's bishop needs to have a talk with him about the moral teaching of The Church, in re Capital Punishment.
Extracts from wikipedia:

Modification to the Catechism (2018)

Recourse to the death penalty on the part of legitimate authority, following a fair trial, was long considered an appropriate response to the gravity of certain crimes and an acceptable, albeit extreme, means of safeguarding the common good.

Today, however, there is an increasing awareness that the dignity of the person is not lost even after the commission of very serious crimes. In addition, a new understanding has emerged of the significance of penal sanctions imposed by the state. Lastly, more effective systems of detention have been developed, which ensure the due protection of citizens but, at the same time, do not definitively deprive the guilty of the possibility of redemption.

Consequently, the Church teaches, in the light of the Gospel, that "the death penalty is inadmissible because it is an attack on the inviolability and dignity of the person", and she works with determination for its abolition worldwide.

Fratelli tutti (2020)

In his 2020 encyclical Fratelli tutti, Pope Francis repeats that the death penalty is "inadmissible" and "there can be no stepping back from this position".

"The firm rejection of the death penalty shows to what extent it is possible to recognize the inalienable dignity of every human being and to accept that he or she has a place in this universe.

On 9 January 2022, Pope Francis stated in his annual speech to Vatican ambassadors: "The death penalty cannot be employed for a purported state justice, since it does not constitute a deterrent nor render justice to victims, but only fuels the thirst for vengeance".

Dignitas Infinita, released on 8 April 2024, states the death penalty "violates the inalienable dignity of every person, regardless of the circumstances" and that "the firm rejection of the death penalty shows to what extent it is possible to recognize the inalienable dignity of every human being"

If you had any doubt Scalia was, or Alito is, dishonest about “Originalism” Alito wants to set the record straight: It’s a con job to cover for getting what they want. Sometimes, you see, “there is “an unmistakable inference from constitutional structure”. But privacy isn’t one of those.
• Show-it-to-me-in-black-and-white originalism.

An originalist judge must always start with the text of the Constitution and be wary about going beyond it. But there are times when an important originalist principle isn't set out explicitly but emerges from the Constitution's structure.

One example is the anticommandeering principle that provided the basis for Justice Antonin Scalia's opinion for the court in Printz v. U.S. (1997) and mine in Murphy v. National Collegiate
Athletic Association (2018).

No provision of the Constitution says in so many words that Congress may not compel state officials to carry out federal law-enforcement responsibilities or to enact legislation. But that is an unmistakable inference from constitutional structure. The
same is true of the presidential immunity we recognized in Trump v. U.S. (2024).

No. The hold a FEDERAL OFFICE, in DC, which is defined by Art 1. All elections in the US are run by States. By your metric, the President is a "STATE office" because Each State runs it's own elections to determine whom the State votes for. It's all in Art 1 §§ 3-4
The times, places and manner of holding elections for Senators and Representatives, shall be prescribed in each state by the legislature thereof; but the Congress may at any time by law make or alter such regulations, except as to the places of choosing Senators.

The Congress shall assemble at least once in every year, and such meeting shall be on the first Monday in December, unless they shall by law appoint a different day.The Senate of the United States shall be composed of two Senators from each state, chosen by the legislature thereof, for six years; and each Senator shall have one vote.

Immediately after they shall be assembled in consequence of the first election, they shall be divided as equally as may be into three classes. The seats of the Senators of the first class shall be vacated at the expiration of the second year, of the second class at the expiration of the fourth year, and the third class at the expiration of the sixth year, so that one third may be chosen every second year; and if vacancies happen by resignation, or otherwise, during the recess of the legislature of any state, the executive thereof may make temporary appointments until the next meeting of the legislature, which shall then fill such vacancies.
