Virginia’s proposal is particularly non-sensical. Not to mention onerous for services with significant (or exclusive) web traffic where usage tracking is difficult—if not impossible.

Seems like an unlikely case—the response highlights that the 230 argument was not developed below so would not be properly before the court here. If SCOTUS takes a 230 case they probably want it to be a clean vehicle, unlikely to be this one from my POV

To be clear, the injunction still *exists* it's just not effective right now. Briefing is underway to see how the Fifth Circuit will ultimately come out on the question of whether to keep the injunction or not. (Not a huge comfort to folks facing enforcement I'd imagine, just wanted to flag.)

Indeed. Freedom of speech requires the ability to offend and desecrate the symbols of freedom. Without that ability, freedom would be illusory. The State would be empowered to compel allegiance, professions of belief &c. The First Amendment’s guarantees are not so easily brushed aside.
