When he wrote to the Judiciary Committee to inform them that Lankford's staff and DOJ was switching the court he's nominated to, he also disclosed the church membership "out of an abundance of caution" because he wasn't sure if it was responsive to the question that asks for all of his memberships.

Judicial nom Trevor Pemberton didn't initially disclose to the Judiciary Committee that he's a member of Skyline Church. One bio says "He is an engaged member of Skyline Church and, above all, a follower of Jesus Christ." Skyline's website says "We want Jesus to be the center of all that we do."

Trump just announced three more lifetime judicial nominees: Todd Butler for the 5th Circuit, Philip Aubart for the Middle District of North Carolina, and Brian Meyers for the Eastern District of North Carolina. Writing up a brief-ish story now about them. Hoping he's DONE with just three nominees.

Sixteen nominees are pending — three on the floor and 13 in the Judiciary Committee (10 have had a hearing). So far, 56 lifetime judges have been confirmed during Trump 2.0 — and Trump has 290 lifetime confirmations overall. Lots of vacancies remain, but time is running out to fill more this year.

Well, dang. The Senate just adjourned until Monday, November 9. They left three lifetime judicial nominees pending on the Senate floor. Those nominees — Daniel Domenico (10th Circuit), Anna St. John (5th Circuit), & Gregory Cook (N.D. Alabama) — will have to wait for votes until after the midterms.

Bobby Long, who had his hearing today, was also a Blackstone legal fellow at ADF. A number of Trump nominees have completed the fellowship or have other connections to them.

Recall that Ballou is the Kentucky nominee who was publicly reprimanded for violating the code of judicial conduct after he engaged in political activity as a judge. This could have contributed to his NQ minority rating, but the ABA probably won't say. nominationnotes.substack.com/p/kentucky-j...

The ABA Standing Committee on the Federal Judiciary just released ratings for the six judicial nominees who had a hearing on September 16. They're all rated Qualified or Well Qualified. Notably, though, Daniel Ballou and Zach West were rated Not Qualified by a minority of the Standing Committee.

As a district court judge, Lee Rudofsky ignored decades of precedent and ruled that there’s no private right of action under Section 2 of the Voting Rights Act. He stood by that decision today, saying "I to this day believe that my ruling was correct — correct according to the law."

Jesus Osete was astonishingly blunt when talking about voting rights, repeatedly calling voter ID laws “common-sense” and saying he had the “honor” of defending them. Many nominees would have said they couldn’t talk about their beliefs because the issue could come before them as a judge. Not Osete.

Jesus Osete, Harmeet Dhillon's deputy at the Civil Rights Division, is very openly talking about his personal views about voter ID/voting rights at his confirmation hearing. But when Senators Blumenthal & Welch asked him about the 2020 election, he hides behind the judicial canons. It's very stark.

Chair Grassley just clarified at this morning's hearing that Brad Kelley's absence today is a paperwork issue. "This was a delay in getting paperwork from the FBI," he said. Said it does not reflect his qualifications. He didn't reference Adkisson's absence or comment on whether he's being blocked.

Adkisson, who is a Trump loyalist, isn’t even admitted to practice in the Eastern District of Tennessee (where he was nominated to serve). He has also spent his very short legal career weaponizing civil rights law. nominationnotes.substack.com/p/tennessee-...

According to Mike Davis, Sen. Blackburn is blocking Samuel Adkisson's nomination to the Eastern District of Tennessee. Adkisson is a White House lawyer who graduated from law school eight years ago and who has never practiced in Tennessee. "This is a grave mistake by Marsha Blackburn," Davis says.
In a stunning development, U.S. Senator @MarshaBlackburn (R-Tenn.) is blocking President Trump’s nomination of Sam Adkisson to serve as a U.S. district judge. Sam served as a Senate Judiciary Committee special counsel for Chairman Grassley during the Kavanaugh confirmation, clerked for two leading conservative appellate judges, clerked on the Supreme Court, litigated for years at one of the best law firms, and currently serves as associate counsel to President Trump. We could not get a more brilliant, conservative, bold, and fearless pick for the federal bench. This is a grave mistake by Marsha Blackburn.

Interesting: The page was just updated, and only four of these nominees are listed. Kelley and Adkisson aren't included. And Phil Axt, nominated to the District of North Dakota, is also missing, though his questionnaire hasn't been posted by the Judiciary Committee yet either.

The Senate Judiciary Committee is scheduled to hold a hearing tomorrow morning on more of Trump's judicial nominees. But at almost 10 p.m. ET, the hearing page still doesn't list who the nominees are. Thursday's markup has already been cancelled. Those nominees will presumably be deemed held over.

There is no indication at the moment that the Senate will be confirming any other judicial nominees before the midterms. With the Senate adjourned and no cloture filed, a nominee could not be confirmed until at least Friday (if cloture is filed tomorrow), and the Senate is usually gone by then.

West also failed to disclose his participation in Arizona v. Mayorkas, though his name appeared on a multi-state Supreme Court brief. West appeared on the brief alongside several other Trump 2.0 judicial nominees, including Benjamin Flowers, Edmund LaCour, Katie Lane, and Tony Powell.

His September 15 letter to Chair Grassley and Ranking Member Durbin also explains why his nomination was switched from the Northern District of Oklahoma to the Eastern District, though the Department of Justice did not respond to my inquiry for more information about why OLP sought this switch.

Speaking of Senator Eric Schmitt, he will likely introduce this nominee at tomorrow's Senate Judiciary Committee hearing. Osete worked for Schmitt in the Missouri attorney general's office, along with almost every Missouri nominee during Trump's second term. Not a great group!
