Courts have refused to quantify the legal concept of "probable cause." But why not? Are Justices just afraid of math? In this 2012 essay, I argue that putting a percentage on it would be bad: It would lead to less accurate probable cause determinations. papers.ssrn.com/sol3/papers....

Agents had a warrant to search suspect's home, & once in the curtilage they seized his car for asset forfeiture purposes. CA2, per Nathan: Warrant didn't need to include the car, as the car could be seized under the auto exception once officers were on property. ww3.ca2.uscourts.gov/decisions/OP...

The label "genius grant" for the MacArthur Fellows is unfortunate—it's a set of people the folks at MacArthur find inspiring, not "geniuses"—but they have marvelous taste in jazz musicians. Congrats to the great Immanuel Wilkins for being named one of this year's Fellows.

Debates over legal liability for AI agents always remind me a bit of the early spring gun cases, like Bird v. Holbrook, 30 E.R. 911 (C.P. 1828). AI is new in a lot of ways, but the issue of legal liability for harms conducted by machines programmed to act on their own is not the new part.

Use of a cell-site simulator is a Fourth Amendment search under Chatrie and Carpenter, Fourth Circuit holds, agreeing w/ Maryland courts. (But also, there is QI here, as no federal court of appeals has reached the issue yet and this occurred back in 2014.) www.ca4.uscourts.gov/opinions/181...

Couple get in business trouble in the 1980s, and in 1987 they invent new lives by taking names & identities of infants who recently died. Live under those names for 30+ years, before govt realizes it. Held: Applying for govt ID in the infant's names after 30 years of use is still ID theft.

This is a very broad opinion, but note one limit: The court leaves undecided whether a forensic search, using Cellebrite tools, etc., could justify a different rule.

2d Circuit holds that no warrant and no suspicion is needed to search a citizen's cell phone at the border. According to the court, per Judge Menashi, the border search exception authorizes searches to find criminals crossing the border, and Riley does not apply. ww3.ca2.uscourts.gov/decisions/OP...

It violated the 4th Amendment, and there's no qualified immunity, when child welfare workers entered the home to make a child safety check based on an anonymous report that a parent was upset and agitated at school dropoff that morning. www2.ca3.uscourts.gov/opinarch/231...

Evidentiary hearing to be held in N.D. Cal on how Flock cameras work to help w/ suppression motion. (In the old days, there would be a DOJ team of lawyers strategizing on the govt side of this, to counter the civil liberties groups doing the same, but I don't know if DOJ works that way any more.)

I am not a fan of the term "criminal legal system," as it's too obviously used with an ideological point in mind. But those trying to make it at a standard phrase in the law reviews have succeeded. Here, # articles in Westlaw's JLR database using it per year, versus "criminal justice system."

Use of drug detection dogs in open spaces is still not a search, even after the new Chatrie ruling, 10th Circuit holds: Dog sniffs are limited privacy invasions, as they only detect odors in the immediate area. This isn't invasive enough to be a search. www.ca10.uscourts.gov/sites/ca10/f...

If I follow this correctly, federal border agents are investigating suspects for narcotics trafficking based on federal databases, & then tipping off local police to be on the look out for them—watching for traffic violations, which most commit, to justify stops. www.404media.co/a-secretive-...

1st officer illegally extends traffic stop to ask about drugs. Can't get probable cause, so lets driver go, but messages other officers to BOLO. An hour later, 2nd officer sees car, observes traffic violation, makes 2nd stop, finds drugs. CA7: Taint attenuated, no suppression.

During traffic stop, officer sees smoked-down butt of a cigar on the passenger seat. Kansas SCT: Its incriminating nature was immediately apparent under the plain view exception, as this was enough to have probable cause, allowing its seizure. searchdro.kscourts.gov/documents/pd...
