CEZ to challenge regulation over Diag Human in Luxembourg court | Prague Stock Exchange
Prague, Oct 13 (CTK) - The Czech semi-state energy group CEZ will challenge the ruling in the Diag Human case in a Luxembourg court and CEZ representatives are convinced they will succeed, Prime Minister Andrej Babis (ANO) told CTK today. Babis said this will not affect the company’s operation and its customers in the Czech Republic. Analysts also said that the freezing of CEZ's stakes in Luxembourg-based companies would not significantly affect the energy company's operations and the price of its shares. On Monday, CEZ posted on its website that a Luxembourg court had frozen its stakes in two local companies through which CEZ owns the gas distributor GasNet, due to the Diag Human case. In the Diag Human case, Czech-Swiss businessman Josef Stava is seeking approximately 17 billion crowns in compensation from the Czech state. "According to my information, CEZ will challenge this ruling in a Luxembourg court and is confident it will succeed. In any case, this will not affect the activities of CEZ or customers in the Czech Republic in any way. This whole affair dates back to 1992, when the Civic Democrat (ODS) politicians signed arbitration clauses in this matter, thereby causing significant harm to the state. However, the state has never, not even for a moment, acknowledged the legitimacy of Diag Human’s claim, and we will, of course, continue to defend ourselves," said Babis. He stated that under his leadership, the government had always done its utmost to succeed in this dispute. Babi said that in case of former finance ministers Zbynek Stanjura (ODS) and Miroslav Kalousek (formerly TOP 09), who have been linked to businessman Stava, it is hard to say what they agreed upon. CEZ stated that it had received notice from a Luxembourg bailiff regarding the issuance of two decisions concerning Czech Gas Networks S.a r.l. (CGN), in which CEZ holds a roughly 55 percent stake, and Czech Gas Networks Investments S.a r.l. (CGNI), which is wholly owned by CGN. CGNI owns the Czech company Czech Grid Holding, which in turn owns GasNet and GasNet Sluzby. The Czech government is the majority owner of CEZ, with a stake of about 70 percent. According to CEZ, the rulings follow legal actions taken by Diag Human in Luxembourg, in connection with compensation the company is seeking from the Czech government. The Diag Human case broke out in 1991, when the Czech Health Ministry announced a tender for blood plasma processing. It reached a preliminary agreement with Novo Nordisk and Conneco, which later became Diag Human. In 1992, then health minister informed Novo Nordisk that it had not won the tender, and a letter from the ministry to Novo Nordisk expressed doubts about Conneco's reliability. Stava has been in litigation with the Czech Republic ever since. A London court ruling last year upheld Stava’s claim. The website HlidaciPes.org then reported that Diag Human had initiated legal action to seek damages and was targeting two companies in which CEZ holds a stake. At that time, CEZ told CTK that this had not affected GasNet’s operations. ($1 = 21.809 crowns) hol/dr/kva CZ0005112300

CEZ stake freeze in Luxembourg not to affect firm's activity-analysts | Prague Stock Exchange
Prague, Oct 13 (CTK) - The freezing of stakes held by Czech semi-state energy group CEZ in Luxembourg-based companies through which CEZ owns gas distributor GasNet will have no significant impact on the firm's operations and its shares' price, according to analysts polled by CTK. The Luxembourg court's decision to freeze the stakes stems from Czech-Swiss businessman Josef Stava seeking around CZK17bn in compensation from the state in the Diag Human case. CEZ said that the move by the Luxembourg authorities is unlawful and vexatious. The company said that it had nothing to do with the Diag Human case and that it will file lawsuits against the decision. "This is not harassment, let alone harassment directed at CEZ, but the long-delayed enforcement of a creditor's rights against a debtor. The core of the problem is the conduct of the debtor, the Czech Republic, which refuses to meet its obligations as ordered by final judgments of an independent court," the law firm of Jan Kalvoda, which represents Diag Human in legal matters, told CTK today. The Czech Finance Ministry is a party to the dispute with Diag Human before the Supreme Court in London over the annulment of an arbitral award issued in an international investment arbitration in spring 2022, which the Czech Republic disputes. The ministry told CTK today that it is not a party to the current proceedings in Luxembourg. From an operational perspective, the impact on CEZ is practically zero, XTB analyst Tomas Maxa told CTK. The freeze applies exclusively to the exercise of ownership rights at the holding company level, which means that CEZ is currently unable to formally sell or transfer these stakes. According to Maxa, the situation could cause short-term nervousness and slight downward pressure on the shares, but CEZ has already announced immediate legal steps to defend itself, which could clarify the situation in its favour. In the longer term, Maxa does not expect the legal dispute to have a significant impact on the company's share price. The shares are rising today. "The decision concerns only CEZ's Luxembourg assets. However, from our layman's perspective, it will have no impact on business in the Czech Republic. It should not in any way restrict the operations and cash flows of the companies," Komercni banka analyst Bohumil Trampota said. Diag Human has no legal claims against CEZ. These should be directed exclusively against the Czech Republic, not CEZ, Trampota added. CEZ received notice from a Luxembourg bailiff regarding the issuance of two decisions concerning Czech Gas Networks S.a r.l. (CGN), in which CEZ holds a roughly 55 percent stake, and Czech Gas Networks Investments S.a r.l. (CGNI), which is wholly owned by CGN. CGNI owns Czech company Czech Grid Holding, which in turn owns GasNet and GasNet Sluzby. The Czech government is the majority owner of CEZ, with a stake of about 70 percent. According to CEZ, the decisions follow steps taken by Diag Human in Luxembourg in connection with the compensation it is seeking from the Czech state. "According to the notice, these decisions restrict CGN and CGNI from disposing of assets belonging to the Czech Republic and CEZ that are held by these companies," CEZ said. The Diag Human case broke out in 1991, when the Czech Health Ministry announced a tender for blood plasma processing. It reached a preliminary agreement with Novo Nordisk and Conneco, which later became Diag Human. In 1992, the then Health Minister Martin Bojar informed Novo Nordisk that it had not won the tender, and a letter from the ministry to Novo Nordisk expressed doubts about Conneco's reliability. Stava has been in litigation with the Czech Republic ever since. A London court ruling last year upheld Stava’s claim. baf/er CZ0005112300 CZ0008019106

New Regional Cooperation Launched to Accelerate Energy Transition in Latin America and the Caribbean
irena.org
New Regional Cooperation Launched to Accelerate Energy Transition in Latin America and the Caribbean
Renewables account for around two-third of electricity generation across Latin America and the Caribbean today. But the region is endowed with a much larger potential of abundant renewable energy resources, providing a strong foundation for accelerating energy transitions. In this context, the Partnership for Accelerating Renewables in Latin America and the Caribbean (PARLAC), a new regional cooperation platform by IRENA, responds to the regional need. To tap into the region’s significant renewable energy potential, it aims to bridge the gap between ambition, planning and implementation by supporting countries in translating long-term energy transition strategies into actionable pathways and investment programmes that foster socioeconomic benefits and opportunities. A dedicated Global High-Level Forum on Energy Transition co-chaired by Joel Santos, Minister of Energy and Mines of the Dominican Republic and current President of the IRENA Assembly as well as IRENA’s Director-General Francesco La Camera provided the platform for the launch in Santo Domingo. PARLAC will serve as an initiative for regional cooperation aimed at accelerating the deployment of renewable energy technologies and electrification, complementing existing platforms like the SIDS Lighthouses Initiative. As a platform of IRENA member states, PARLAC will provide a mechanism at the regional level to coordinate and optimise actions with strategic partners to accelerate national energy transition as well as develop and implement regional and cross-border energy transition initiatives. During the event, IRENA and the Government of the Dominican Republic signed a Letter of Intent to advance cooperation on energy transition, including through the newly launched Partnership for Accelerating Renewables in Latin America and the Caribbean (PARLAC). With focus on policy planning, investment facilitation, and knowledge sharing, the cooperation will help translate regional energy ambitions into practical action. IRENA estimates that decarbonising Central America’s power system will require around USD 3.5 billion in annual investment through 2050 in renewable generation, transmission, distribution and related infrastructure, while achieving the Paris Agreement’s climate goal in South America would require around USD 500 billion annually in energy projects and end-use applications over the next 25 years. In the Caribbean, meeting the renewable energy ambitions reflected in national climate plans could require around 4 GW of additional renewable capacity and USD 9 billion in investment. To help meet this challenge, IRENA and the Ministry of Energy and Mines of the Dominican Republic also hosted the first Central America and the Caribbean Energy Transition Investment Forum taking place in parallel with the OLACDE Energy Minister Meeting and Energy Week in the Dominican Republic capital. Read more about IRENA’s regional cooperation initiatives:

New ICC-HK committee chair shares reform plans for Hong Kong
Kathryn Sanger, newly appointed chair of the Standing Committee on Arbitration and ADR at the International Chamber of Commerce – Hong Kong(ICC-HK), unveils her plans during her tenure. Sanger, head of disputes for China and Japan at Herbert Smith Freehills Kramer, said her plans from the get-go would focus on Hong Kong’s ongoing reforms of its Arbitration Ordinance. The Department of Justice launched a stakeholder consultation on the reforms on 28 September 2026, with feedback due by 27 October. “Short term, we want to ensure that Hong Kong continues to contribute substantively toand is seen as an integral part of the ICC’s global network,” she told Asia Business Law Journal. “Locally, one immediate priority will be to contribute to the ongoing reforms of Hong Kong’s Arbitration Ordinance, as well as ICC initiatives, such as the AI Taskforce.” Providing a longer-term outlook, Sanger said she aimed to continue reinforcing Hong Kong’s standing as a dispute resolution hub. “Longer term, our aims are to preserve and enhance Hong Kong’s status as a global dispute resolution hub. That would include an increase in both ICC memberships locally and the number of ICC arbitrations seated in Hong Kong and the wider region,” she said. Sanger began her term on 1 October 2026. She is supported by vice-chairs Yvonne Shek, counsel at Clifford Chance, and Sherlin Tung, a consultant at Withers. She succeeds Rory McAlpine of Skadden, Arps, Slate, Meagher & Flom, who stepped down after leading the committee for seven years.
