Answer:
The Constitution does not give the president the power to run or set the rules for federal elections. States have the main job if administering them. Congress can change most of those rules by statue. The president's role is to enforce existing federal law, not to replace state or congressional election rules.

Smith's own report says it plainly, if Trump hadn't won reelection, the evidence was enough to convict and sustain that conviction at trial. He didn't escape the law, he outran the clock. Meanwhile the guy pushing seashell photo charges against Comey is the one calling Smith the criminal.
