Now you must be wondering, what is the cause for this? Well, affordable housing developers are sick of dealing with NIMBYs in high resource areas. So instead of doing the valiant thing of fighting for more housing in exclusionary areas... they want to secretly end it...so the rule change...

We already know how this plays out. The 9% program has only ever had the tiebreaker, no determinative point, and its siting patterns barely moved compared to the 4% program. That's the likely future for 4% deals too.

Under the proposed regs, that determinative point disappears. Only the tiebreaker remains, and it's just one part of the location benefit category (Section 32041(a)(3)). Projects can rack up location points other ways too, which dilutes the pull toward high-resource siting.

Why the jump? In the 4% program, current regs give an extra, determinative point to projects in high/highest-resource areas (it phases off after 50% of resources are allocated), plus a tiebreaker benefit. So what does California do when programs are too successful? End them!

Some (slightly dated) data on why this matters. Pre-incentive, 14% of large family projects were sited in high/highest-resource areas. Post-incentive, that jumped to 44%. For context, about 41% of CA census tracts are high/highest resource.

Within 7 years, ADUs are already at about a third the scale of owner-occupied condos nationally (1.6M vs. 5.4M). If we can make ADUs a real homeownership pathway, that's a meaningful chunk of new homeownership supply.

AB 1903 by @buffywicks.bsky.social passed the State Senate tonight, but did not get a concurrence vote on the Assembly floor before session expired. Therefore, the bill is dead. We will continue to work on construction defect reform to help build more starter homes residents can afford!

It also establishes a baseline of proof for defects, with photos and written documentation provided to builders to provide a transparent record of defect claims. What was lost: Read the amendments. This is a step forward and the first time construction defect reform has happened in over 2 decades

AB 1903 creates a new disclosure requirement for new starter homes that informs owners of their right to seek repairs for proven defects. It removes the ability of Homeowner’s Associations to block successful repairs when the owner and builder have agreed in writing that repairs were successful.

The most diverse bill support list I have ever seen and the bill might go down because the tort attorneys have so much money. We need homeownership opportunities in California. Construction defect reform is vital for us to achieve this.
