Specifically they will appeal it to the 5th circuit, who will be all-in on building the wall and override the lower court judge. The plaintiffs will then appeal to the Supreme Court who will deny any type of halt to construction.

100% agree. Just as helmets don’t prevent all bike TBIs or deaths, especially those involving getting hit by cars. But if say 20% of car deaths and TBIs could be solved with car helmets, why wouldn’t you advocate for them? And why wouldn’t you wear one yourself?

Well, if I compare Netherlands cycling injury rates to USA cycling injury rates (per time or distance exposure), I could conclude that wearing helmets creates a higher cycling injury rate. Or correctly that small investments in cycling infrastructure are what really impact cycling injury rates.

Naive questions from a non-lawyer: why is it so hard for judges to get GJ transcripts (the defense had to request multiple times, because they somehow had wind of misconduct here)? And why is it not standard practice for the judge to review GJ transcripts before proceeding with a case?

Drive aisles in a parking lot are more analogous to hallways in a house. You don’t sleep or eat in the hallway but you do use it to get from the bedroom to the dining room, and we include the hallway in the square footage of the house. The sidewalk is more analogous to the road next to the lot.
