Last night, NJ passed the New Jersey Kids Code Act, protecting kids online by regulating the design of online products! Many of the Act’s key components came from EPIC’s model AADC bill. All that's left now is Gov. Sherrill’s signature. Read more here: epic.org/epic-applaud...

Meta's attorney in the MA addictive design case told the Supreme Judicial Court that @epic.org was wrong about how the 9th Circuit interprets Section 230. But it's Meta who is wrong. & it should know better—just last year, the 9th rejected Meta's plea that it adopt the test Meta says it adopted.

Tomorrow, the Massachusetts Supreme Judicial Court will hear oral arguments on whether the Commonwealth can continue to pursue its case against Meta. Meta is trying to block the case by expanding Section 230 into a broad legal protection, arguing it shouldn’t face scrutiny for its platform design.

This is such brazen censorship. It’s all right there in the open, a quintessential jawboning case, the lawsuit writes itself.

The California Age-Appropriate Design Code case is back in the 9th Circuit. Did NetChoice remedy the flaws the Ninth Circuit ID'ed the first time around? Nope. But the district court granted a full injunction anyway—endorsing yet another bad legal theory that endangers long-established privacy laws

The "Is it a constitutional crisis yet?!" discussion is so absurd: Of course you can construct increasingly esoteric definitions for why this current moment doesn't meet your exact criteria yet. But meanwhile, this is where we are: Masked agents of the states abducting people for writing op-eds.

My analysis of the decision issued yesterday in the CA Age-Appropriate Design Code case. Short of it is that the First Amendment analysis is wrong and unnecessary and the judge shouldn’t have opined on the constitutional questions at all b/c the case could have been decided on severability.

When will Democrats learn you can’t out-Republican the Republicans but you can deploy populism to address the actual problems we’re facing. Trump is dismantling democracy, he is screwing with your social security, he is shredding the freedom to speak, and he’s making every damn one of us less safe.

The Ninth Circuit has enjoined California's law regulating addictive feeds pending appeal. No opinion attached. Merits briefing in the appeal will proceed on an expedited schedule (completed by mid-to-late March) and hopefully we won't have to wait too long for the Ninth Circuit to rule thereafter.

Meta’s move effectively puts an end to its longstanding fact-checking program. Here’s the latest.
The social networking giant will stop using third-party fact checkers and instead rely on users to add notes to posts. It is likely to please President-elect Trump and his conservative allies.

Check out this amicus! The PA Supreme Court has an opportunity to make online contracting much more prosocial by requiring informed consent. Added bonus, tech companies will be incentivized to limit contract terms to limit friction, so less click wrapped bullshit.

Well, it was a good two days—district court places California’s addictive feed law on hold through Feb 2 pending appellate proceedings.
F or these reasons, the Court finds that an injunction pending appeal is appropriate to allow the opportunity for appellate review of theseweighty issues before the law goes into effect. However, Defendant also has a countervailing interest in seeing a duly enacted law(at least, the parts of which this Court has already concluded are likely constitutional)go into effect. Therefore, the Court concludes that an injunction pending appeal is only appropriate to the extent it allows the Ninth Circuit time toconsider whether to grant its own injunction pending appeal. Accordingly, the CourtGRANTSIN PART NetChoice’s motion. Defendant is ENJOINEDfrom enforcing the entirety of SB 976 for thirty (30) days until February 1, 2025 at 11:59 p.m. PT. At that time, if the Ninth Circuit has not extended this injunction pending appeal or issued its own, this injunction shall dissolve and the more limited injunction issued in the Court’s preliminary injunction order (ECF No. 39) shall take effect
