The amendment was defeated. Many of the women involved in this campaign wondered if they could achieve more through such activism. The Santama Association was officially formed in 1985, with the passage of Japan's equal opportunity law.

Around 1982, there was a move by legislators to remove that condition, effectively outlawing abortion. Women across the country mobilised to oppose the legal amendment. The founders of the Santama Association counted among them.

A bit of background. Under the Eugenic Protection Law of 1948, abortion was illegal but permitted in certain circumstances. One of these was if a newborn would present undue health or economic pressure. Virtually all abortions performed in Japan cited this condition.

Sex clubs starting calling themselves "sekuhara" joints, and men would often use it in jokes. Activists feared it would be trivialised. Sekuhara probably took root as a term because it was much more convenient to use, and didn't affect the seriousness with which the issue was treated.

Incidentally, you'll notice the award was for セクシャル・ハラスメント and not the shortened, and now more popular usage, セクハラ. This was deliberate. Not everyone liked セクハラ (sekuhara). Some thought it sounded too flippant and wanted "SH" instead. Few knew what SH meant, however.

At the awards in 1989, Kazuko Kawamoto was uncomfortable for two reasons. Firstly, she kept being asked if she had coined the term, something she had never claimed . Secondly, the ceremony staff were all in short skirts, which she thought inappropriate for a ceremony recognising セクシャル・ハラスメント.

In the article at the top of this thread, Tsujimoto gives great credit to the work of these supporters. They handled publicity, newsletters and interview requests, which allowed the lawyers to focus on the trial. She believes they could not have won without their help.

There were also similarities in the way the cases were conducted. Women's support groups rallied for both cases. They packed the galleries in court, and looked to influence media coverage, and sway public opinion.

This isn't to say Kazuko Kawamoto accepted the 1989 neologism award on false pretences. She was approached to do so, because the term was seen as encompassing women’s rights, which she had successfully represented in the 1987 case.

Five years after the verdict, in 1997, Japan amended its Equal Employment Opportunity Law to require companies to prevent workplace sexual harassment. It took until 2006 for another amendment to strengthen those obligations, and give the law some real teeth. www.japantimes.co.jp/news/2026/03...

Hirano's victory in court was significant, because she had sued her employer, not the obnoxious, harassing manager. The judgement found the firm liable, which meant other firms could be held responsible for similar conduct in their workplaces. It wasn't just a personal dispute.

For years, she had no approaches. As she says, that would have been fine if no-one was suffering discrimination but she knew otherwise. Consequently, she set up her own firm, and went on a media blitz to advertise her willingness to take on such cases.

At one point, the defence said Haruno was a party girl, who often stayed out drinking all night. 「原告は夜遊び好きで朝帰りしていた」. Haruno's team replied「なぜ女性が朝帰りしたら駄目なんですか」 (What's wrong with a woman staying out all night?) and Judge Kawamoto says that's when he understood the unfairness at stake.

Although this case was the direct reason セクシャルハラスメント became known as a term, it hadn't finished when the neologism prize was announced. Also, Haruno's desire for anonymity was apparently another factor for keeping the case separate from the award.

In September 1987, Chiba District Court ruled the accused acted in self-defence, and did not use excessive force. She was exonerated. The prosecution elected not to appeal, so this case was seen as a big victory for the right of a woman to protect herself against abuse.

Many sympathised with the accused, especially when it transpired she was a mother of three, and the main earner in the family, as her husband was deaf. A womens support group formed for the defendant. They attended court everyday, and campaigned to turn public opinion her way.

The woman was arrested, and charged with 傷害致死罪 (a form of manslaughter). Prosecutors wanted a 2 year sentence. She claimed self-defence. The dead man was a high school sports teacher, while the accused worked as a stripper. There was extensive media coverage.

Instead, he stumbled slowly back towards his own side. Commuters urged him on, as the train was now visible, and approaching fast. He got back to the platform, where people tried to help him but he couldn't scramble up. The train hit him, and he was killed instantly.

Just as he let go, the woman pushed him away, causing him to stagger. Unable to regain his balance, the drunken man fell off the platform onto the tracks. There was no train coming but one was due. Passengers on the opposite platform shouted at him to move to their side, but he didn't.
