Conclusion
98․ The appellant has not established error in the primary judge’s conclusion in order 1(a) of
McBride (No 2) that the oath of enlistment taken by the appellant does not define the
duty of the appellant for the purposes of s 73A of the Defence Act and s 70 of the Crimes
Act as extending to acting in the Australian public interest, even where in contravention
of a lawful order. Nor has he established error in the primary judge’s conclusion in order
1(b) of McBride (No 2) that a lawful order contained in a “general order”, within the
meaning of the Discipline Act, may define the scope of the duty of the accused under
s 73A of the Defence Act and s 70 of the Crimes Act. To put it another way relevant to
this case, a communication of the type referred to in s 73A or s 70 may not be in the
course of a person’s “official duty” if that person was under a duty (which arises from,
inter alia, general orders) not to make that communication.

After a less than one minute session, the three judges of the Supreme Court in Canberra announced that David McBride's appealS had been "dismissed." McBride appeared in the courtroom for the less than 60-second hearing to learn his fate: he is going right back to jail. McBride has nearly five more years in jail to serve for leaking documents to the media exposing Australian war crimes in Afghanistan. This means all of his appeals, including liberation from jail, a reduced sentence or community service were rejected out of hand. McBride waved to his lawyer Eddie Lloyd and just a few of his supporters who found out which courtroom it was in. Normally a huge board in the lobby of the courthouse posts the names and courtroom numbers on the docket that day. But McBride's name was nowhere to be found keeping supporters from entering the courtroom. The next step for McBride is to ask leave of the High Court, Australia's highest court, which could take many months for them to respond with no guarantee the High Court would take the case.

Statement on David McBride’s Appeal Judgment 28 May 2025

The Court of Appeal has dismissed David McBride’s appeal. We are disappointed — but we are not surprised.

As usual, after the judgment, Dvid McBride remained stoic and concerned for others.

“I am concerned for my children and family.

People who have stood up for what is right in history have suffered far more than I have. I thank god for giving me the strength and courage to fight this battle and the strength to continue this pilgrimage for justice.

It is a great privilege to sacrifice for the country and I am confident the outrage produced by this judgment will be felt by all Australians. I will not give up.”

We are disheartened — because David McBride is still not coming home today. And that is a failure of justice. We are disappointed in the court of appeal in their failure to appreciate the public interest issues in this case and the ramifications this decision has for other Australians.

And that is why we are going to the High Court. David said:

‘It is my own conscience and the people of Australia that I answer to. I have kept my oath to the Australian people”

David should never have spent a single day behind bars. Yet as we speak, he is returning to a cold, dark prison cell — preparing for winter in a concrete jungle — while those who committed crimes walk free and those who covered up those crimes have been rewarded with medals and promotions.

But make no mistake: this is far from over. We believe that only the High Court can properly grapple with the immense public interest and constitutional issues at the heart of this case. We will be seeking special leave to appeal to the High Court imminently.

This case matters to every Australian. Because it cannot be a crime to expose a crime.
It cannot be illegal to tell the truth. When a soldier acts on conscience to report wrongdoing, their actions must be protected — and their complaint properly investigated. Otherwise, we are not a democracy. We are something else entirely.

The truth is, David McBride has had everything taken from him — but he has not wasted a single second in prison. He has spent the past year becoming mentally, physically, and spiritually stronger than ever before. And when he is finally released — as he will be — he will emerge more determined than ever to serve the public interest and pursue justice for all Australians.

It is now time for the Attorney-General to show leadership. To show Australians that this Labor government will no longer jail whistleblowers. To recommend a pardon — so David can return home to his daughters, to his family, to his community, and to a country that must be brave enough to face the truth.

Because until we stop punishing those who speak truth to power, justice will remain out of reach for us all.

The BRS ‘phenomenon’ didn’t occur in a vacuum, much as Defence will try to pretend it did.

Everything they say and do is based not on what is true, or good for Aust, but what is good for them, and the Minister.

The Subs are Duds. We need a #DefenceRC urgently before the next (inevitable) war.

As one of the SAS withesses in the BRS case said, it’s well known, that medals are given out as a ‘political feel good’ event.
Donaldson was probably the exception, but once they saw the goodwill that flowed towards the leadership (and pollies) they got addicted to it.

One of the key pieces of evidence from the BRS trial, was that he wasn’t at the top of the short-list for the VC, but was elevated to the top by the staffers of the Minister. He was media ‘gold’, and they wanted him, because he bought them kudos. It’s seems incredibly cynical. But that’s the reality of politics.

That’s one of the reasons that it was so hard to bring BRS down, because the staffers and CDF knew that if he went down, he would take them with him.
So as a ‘compromise’ in 2013 they went looking for SAS scapegoats, who actually were just defending themselves in the fog of war.

Regardless of the facts in this case, is it possible that the Govt would cover up the crimes of a famous soldier, and then look for scapegoats?

In 2012 the war was still going and Aust troops were still there. Kicking it down the road was a logical PR tactic.
But I got caught in the middle, as I could see ‘something strange’ was happening with the ‘2013 scapegoats’, and ignored allegations against BRS.
I became the enemy.

Hurley is every bit as culpable in my mind. A political animal, he thought nothing of giving the minister whatever the Ministers staff wanted, either a hero, or a villain. Facts didn’t matter. He was rewarded for it afterwards.
I believed he did more damage to truth in the ADF than BRS.
