My hobby for the past month has been working to personally end an operation on the Cape which has been scamming eye-watering amounts of money from Brazilian immigrants for more than 30 years, run by a guy very much like this. They're always like this

I had a little bit of difficulty writing this because the question "should a higher court overrule a lower court's administrative stay in a way that lets the appellee kill the appellant while the lower court is still reading the briefs" felt like a silly question. And yet.

The Trump administration says none of this is happening. 

"DHS is NOT arresting U.S. citizens by mistake." "There are no 'indiscriminate' stops." Allegations of "racial profiling are disgusting, reckless and categorically FALSE." "The pattern is NOT of law enforcement using force." "ICE does not zip tie or restrain children." 

But that is precisely what is happening, and at a far larger scale than previously reported.

On the upside, every single previously-easy residency case now feels like a much bigger win! We got notification of two greencard approvals this morning that would have previously been totally routine and it was cause for minor celebration. Every win in this system counts so much more now

Also tbc we starting preparing clients for the "why didn't you consular process" and "why do you deserve discretion" questions immediately, and they have come up. Like one of the plaintiffs in this suit we have had some previously dead-easy cases held up with no decision for awhile

That said, the memo's organizing principle that adjustment is a rare and super-special privilege and that consular processing should be the default is (under current law at least) actively dangerous and dead wrong, and it needs to go. This memo is a loaded gun for any adjudicator to use anytime

I was just re-reading the Yoo torture memos this week. In two paragraphs one of the federal government's most powerful lawyers easily dispensed with the idea that the 8th could possibly apply to "enemy combatants" we send to black sites for the explicit purpose of torturing them. Just words
D. Eighth Amendment
A second constitutional provision that mi·ght be thought.relevant to interrogations is the
Eighth Amendment. The Eighth· Amendment, however, applies solely to those persons upon
whom criminal sanctions have been imposed. As the Supreme Court has explained, the Cruel
and Unusual Punishments Clause "was designed to protect those convicted of crimes."
Ingraham v. Wright, 430 U.S. 651, 664 (1977). As a result, "Eighth Amendment scrutiny is
appropriate only after the State has complied with the constitutional guarantees traditionally
associated with criminal prosecutions." Id. at 671 nAO. The Eighth Amendment thus has no
application to those individuals who have not been punished as part of a criminal proceeding,
ip'espective of the fact that they have been detained by·the government. See Bell v. Wolfish,441
U.S. 520, 536 n.16 (1979) (holding that condition of confinement claims brought by pretrial
detainee must be considered under the Fifth Amendment, not the Eighth Amendment). The
Eighth Amendment therefore cannot extend to the detention of wartime detainees, who have .
. (	 been captured pursuant to the President's power as' Commander in Chief. See Transfers
Memorandum at 2 (concluding that "the President has since the FOWlding era exercised exclusive
and virtually unfettered control over the disposition of enemy soldiers and agents captured in
time of war"). See also Hamdi v. Rumsfeld, 316 F.3d 450,463 (4thCir. 2003) (the President's
powers as Commander in Chief "include the authority to detain those captured in anned
struggle").
The detention· of enemy combatants can in no sense be deemed "punishment" for
purposes of the Eighth Amendment. Unlike imprisonment pursuant to a criminal sanction,. the
detention of enemy combatants involves no sentence judicially imposed or legislatively required
and those detained will be released at the end ofthe conflict. Indeed, it has long been established

And of course while I think this really goes without saying, this is a song very much by and for certain kinds of white people. It is socioethnic nostalgia in much the same way that Ice Cube's "It Was a Good Day" is for '90s Black LA or Cornership's "Brimful of Asha" is for Bollywood

as someone who grew up white and poor with parents who enjoyed country music I do also get very annoyed with the "I like everything *but* country" white libs; she has a point about it how it can serve as a class marker. It is also a statement of musical incuriosity, a huge turnoff for me personally

Country music fans recognize this well. We’ve become so accustomed to hearing the qualifier “I listen to anything but country music” to signal class and taste that it’s become a touchstone in sociological studies of music. As Nadine Hubbs wrote in the book Rednecks, Queers, and Country Music, “distance from country music can help to define one as a middle-class individual, which is precisely a matter of distinguishing oneself from the tastes, characteristics, and people of the working-class masses.” It’s shorthand, often, for liberal politics and a way to separate oneself from anything that could be associated with rural or Southern stereotypes. “I’ve never heard of ‘Choosin’ Texas’” is the “I listen to anything but country” of 2026.
