I should mention I am only protected if treated as a woman because that is assumed to be discrimination by my old sex. Something I do not experiance. Being treated like my birth sex only happens when trying to hurt me BUT i cannot be discriminated by that under the new EQA act This breaks EQA law.

this also raises the question of how protected are we still from discrimination Like I am protected if treated like a woman or specifically if treated differently as trans but not protected if I am treated as a man- this is flipped from how it was & we are not protected from treatment as birth sex.

Being too bigoted to do your Job didn't used to be protected. The way Falkner forced through the most stretched definition of how protected belief should be implemented in practice still exists and is wild. To remind people that the EHRC guidance wrote in specific examples of protected homophobia

It doesn't track with their actions They did not even attempt to appeal the prisons case, they did not support NHS Fife during the sandy Peggy case, they have not stopped police Scotland requiring me to out myself as trans to report a crime & have done nothing about the 900 year Glasgow waiting list

I meant to put this in the thread- but I'll put this separate. While this looks like it is advising people to include trans kids (just separately) this reads like a defacto ban for trans kids from all boarding, schools can deny hosting a trans kid as their facilities cannot provide single occupancy.

This is where things (In my opinion) get more interesting. The small differences between the Scottish and English guidance and what they can recommend. There seems to be less legal backing to enforce transphobia in Scotland than there is in England and the EHRC deliberately avoids mentioning that.

It pretty much says trans kids are not protected against harassment which is wild- same with gay and religious kids. Which is a shocking thing to see in a document I guess this is to how the equality act treats harassment but it seems to put a higher bar on queer or religious kids to prove harm
3.120	The prohibition of harassment does not protect individuals who have the protected characteristics of gender reassignment, sexual orientation or religion or belief in relation to schools. However, where unwanted conduct related to any of these protected characteristics results in a pupil suffering a detriment, that pupil may be able to bring a claim of direct discrimination (section 212, paragraph 5).
Example:
3.121	A disabled pupil is mocked by her teacher because of her disability. The pupil can bring a court case alleging harassment. A gay pupil is mocked by his teacher because of his sexual orientation. This pupil can bring a court case alleging direct discrimination. In both cases, the schools face the same penalties.

While it does say you should exclude trans people- it says you can bar trans boys who have had treatment from competing due to fairness- it does so without ruling out the opposite. I think the EHRC is trying very hard not to say that trans inclusion is broadly legal so they talk only of one part
10.44	Under the Act, any sex-based rules or arrangements relating to participation in a specifically gender-affected activity should be applied on the basis of the sex of a person at birth. Therefore, in a gender-affected activity, trans pupils should not be included in single-sex or separate-sex competitions for the sex with which they identify.
10.45	A school can have policies that restrict participation in single or separate-sex competitions for pupils who have undergone hormonal medical treatment that affects their muscle mass or strength, if this raises a legitimate concern and is justified. For example, this might be on the grounds of safety or fairness. In practice, it is unlikely that pupils will have undergone such treatment due to their age. Therefore, trans pupils should usually be able to participate in single or separate-sex competitions with pupils of their own sex.

Less that 1% of voters put LGBT issues as their top issue. It does not motivate voting- thats for and against. It does signal though that they are willing to throw people under the bus. Being anti-trans DOES NOT gain votes, it does lose support of activists who do groundwork- so can loose elections

The amount of news time spent on this case and the subsequent follow ups is unreal, about 20 articles on the BBC alone last I checked. Dr Beth (A lovely & kind women) has had to leave the UK due to abuse. I met Beth at a trans pride, I was alone- her and her friends chatted with me, truly kind

Am I being reductionist by saying this is downstream of allowing transphobia to run riot in the UK. By earmarking one bigotry as reasonable and a rational concern you open the door to saying the same for others and only leads to other escalation. Reductionist- likely yes. Feels true- also yes.

This study is also famously and obviously bunk. It wanted to show trans people were more mentally ill by proving they had more contact with mental health professionals than non-trans people. Y'know trans kids- who are forced to interact with mental health services to get treatment.

The narrative should always be trans kids should receive best quality healthcare- it should be between the child, the parent and the Dr. The government should be only involved to protect peoples access to healthcare not restrict it. In a world where republicans have scrapped Medicare access.

In Scotland I can no longer report that I am the victim of a crime without revealing that im trans, Ive paid 10k in stuff NHS should cover. If I go to jail it will be men's & I will be subject to massively disproportionate abuse from prisoners and guards. The SNP gave up so now the bigots flourish.

I had an SNP MSP lecture me for 2 hours about how I never had or never should have rights. She put out Harry potter pillows for my arrival to make me know I was unwelcome. She had 3 aides in room with her to agree with her on every point & to agree that "real women can always tell who is trans"

I think my big issue here is yes morally standing for trans rights is important but I think its wrong to believe that moderating on trans rights wins any more support- I've seen no evidence on this. The amount and quality of attack ads do not change, so all that happens is hurt trans people

The situation of wanting to wash your hands at the library is not the same as being a ward of the state in a prison. I do not agree with the prison judgement- but even so the comparison is still wrong. Want to talk prison abuse? Equality law is used to justify men guarding female prisons.
