I take a few shots at Grey v IRC, and the idea a trust can exist without being enforceable, rounding off by agreeing with the CoA maj that this is essentially about sham (transaction at an undervalue under the IA 1986) bearing on constitution of the trust, rather than really being about formalities.

I argue based on the archival materials relating to 1925 that the drafting intention was not to break with the Statute of Frauds, but also that the drafters’ understanding of agency - which bears on this case - was a bit different to what has been thought so far.

Proofs proofs proofs proofs! Produced at high speed to get in there between the Court of Appeal judgment and the UKSC hearing in NIOC v Crescent Gas, my article on the drafting history of s53(1)(b) of the LPA 1925 will be out in the Conveyancer shortly.

Pleased to have the hard copy of 'Epidemics and the Law from Plague to Present' - I'm "plague"! My first publication on contract law, and involves some old school doctrinal #legalhistory, statutory interpretation (what can I say: I like what I like), and a little modern law twist in the middle.

I got into the just sum in BP v Hunt and we agreed that they would keep an admin fee not the whole deposit, as they initially tried to. Their manager seemed a bit shell shocked by the end of the conversation. Good teaching material ever since, though.

Did the policy pay out? Ours didn’t cover infectious disease outbreaks and I ended up giving the venue a lesson on frustration in contract law to get our deposit back.

It’s a bit of a strange scenario in that our wedding was originally planned for 2020. I picked up my wedding dress 3 days before the first lockdown. And then we moved to Scotland, so I was less bothered (no CICT in Scotland!). And now we’re back down, so… 😁

Wrapping up UG teaching for my 1st Cambridge year today, and what an insanely busy one. Teaching across 3 UG papers, LLM students, and PhD projects. Queens' has felt like home fast, and next year looks great: September kicks off with the 1925 Property Conference (and our wedding at Queens'!).

Tomorrow 7pm UK time, Matthew Dyson, Ashley Hannay and I are speaking about teaching legal history in England and Wales. The chapter we've written for an upcoming comparative volume involved empirical research across English/Welsh law schools, and reflects on future directions for the discipline.

Can’t imagine would be extended to unmarried couples or wife->husband, given the distaste, also would really mess up CICT case law and that’s dirty enough already. Generally if exam, I’d think consider it if it falls under a traditional category, dismiss as weak, get on with real analysis.
