Background on the lawsuit: www.lawdork.com/p/ousted-out... Statement from the plaintiffs’ lawyer, Ted Boutrous: “The harm this ban did to our clients, the First Amendment, and the public as a whole is profound. The Court was right to enjoin the White House ….”
We are grateful that the Court ruled in favor of our clients CNN, MS NOW and POLITICO and secured access to the White House for these news media organizations and their journalists. When the President issued his "ban on the free press," he blatantly and explicitly violated due process and the First Amendment. Since then, the President has repeatedly, candidly, and consistently admitted in public that he banned our clients from the White House to punish reporting he doesn't like and to try to force journalists to cover him in ways he prefers. The harm this ban did to our clients, the First Amendment, and the public as a whole is profound. The Court was right to enjoin the White House from enforcing this "unconstitutional ban on the free press" for the foreseeable future.

BREAKING: The Supreme Court takes up Trump administration request to review a lower court decision allowing discovery into DOGE. The case is one of three new cases granted today.

U.S. DOGE SERVICE, ET AL. V. USDC DC, ET AL.
25-1343
BLANCHE, ATTY GEN. V. OZURUMBA, IZUCHUKWU
25-7026
The petitions for writs of certiorari are granted.
BERRY, COREY D. V. UNITED STATES

The motion of petitioner for leave to proceed in forma pauperis and the petition for a writ of certiorari are granted.QUESTIONS PRESENTED
The district court in this case entered a wide-ranging and intrusive discovery order against the U.S. DOGE Service (USDS)—a body within the Executive Office of the President tasked with advising the President—to determine whether that body's influence renders it an "agency" subject to the Freedom of Information Act (FOIA),
5 U.S.C. 552. This Court previously granted certiorari, vacated the court of appeals' denial of a writ of mandamus, and remanded for the court of appeals to "narrow" discovery in light of "separation of powers concerns." On re-mand, respondent withdrew several of its discovery re-quests, and the court of appeals again denied the government's mandamus petition without any new analysis regarding the remaining discovery, which includes numerous requests for internal communications and a deposition of USDS's head. The questions presented are:
1. Whether the court of appeals' order departed from this Court's instructions and the separation-of-powers principles that this Court articulated in Cheney
v. United States District Court, 542 U.S. 367 (2004).
2. Whether a court may order broad discovery against an Executive Office advisory body—potentially providing much information sought on the merits of a plaintiff's FOIA claims—to determine whether FOIA's disclosure requirements apply in the first place.

EMERGENCY MOTION FOR A TEMPORARY RESTRAINING ORDER OR, ALTERNATIVELY, FOR A 14-DAY STAY UNDER SECTION 705 OF THE

Plaintiffs hereby move the Court to enter a 14-day temporary restraining order under Rule
65(b) of the Federal Rules of Civil Procedure or, alternatively, for a 14-day stay under 5 U.S.C.

forward and we can't, you know, stop the trains," Status Conf. Tr. ("Apr. 13 Tr.") at 18:15-19:10,
Apr. 13, 2026, Defendants have begun irreversible damage to East Potomac Golf Course. At
4:55 p.m. on Friday preceding the holiday weekend, Defendants announced their intent to
begin-barely 12 hours later—a massive operation to clear 529 trees at East Potomac Golf
Course. Decl. of Dr. Kevin Griess, Superintendent of National Mall and Memorial Parks,
National Park Service 920, ECF 74-1. Although they initially represented that their work would proceed in stages, Defendants in fact took down 529 trees on Saturday alone and have confirmed
to Plaintiffs that they intend to take down hundreds more.
Defendants' surprise tree-razing operation constitutes classic National Environmental
Policy Act segmentation: undertaking elements of a larger project piecemeal and insisting that they are independent and therefore need not be evaluated in a single NEPA review of the entire
project. Defendants cannot circumvent their NEPA obligations in this manner. Delaware
Riverkeeper Network v. F.E.R.C., 753 F.3d 1304, 1313 (D.C. Cir. 2014).Therefore, and for the reasons explained in the Memorandum accompanying this Motion
and supporting exhibits, the Court should enter a 14-day temporary restraining order under Rule
65(b) of the Federal Rules of Civil Procedure or, alternatively, a 14-day stay under 5 U.S.C.
§ 705, enjoining Defendants from any further tree felling at East Potomac Park. In addition, the
Court should order Defendants to provide the Court and Plaintiffs no less than three business days' written advance notice before any irreparable modification to any permanent forms or
features of East Potomac Park.
If the Court believes a hearing would be appropriate, Plaintiffs request a hearing on this
motion at the Court's first availability. At the parties' meet and confer on Sunday afternoon, Defendants represented that the tree-clearing operation would continue this week until
completed. Defendants indicated during the meet and confer that rain foreclosed any work on

condition. Depending on Defendants' plans, then, it is possible that no work will occur on
Monday.

NEW: The TRO request reply from the plaintiffs in the S.D.N.Y. challenge to the pro-Trump ads echoes some of what I was explaining overnight. It is, independent of that, fire in other ways, too — including asking the court to rule today on the briefing. storage.courtlistener.com/recap/gov.us...
INTRODUCTION
Defendants admit that appropriated funds were used to pay for political ads and do not dispute
that this use of taxpayer money is unlawful. Instead, much of Defendants’ opposition boils down
to a single premise: it is too late for the Court to act. That is not because Defendants have stopped
airing the ads. Indeed, Defendants assert—boldly, given their failure to defend the ads on the
merits—that ads will continue to air today, including during evening programming that will attract
millions of viewers. Rather, Defendants say there is nothing for this Court to do because the
Defendants will stop airing the ads soon—presumably by the time Defendants believe the Court
can rule on the motion. That attempt to run out the clock does not cut against issuing a TRO and a
Section 705 stay; it shows why the Court should grant relief today.

Common Cause's reply is almost certainly going to argue that DOJ did not defend on the merits, so they win as to likelihood of success, and they will likely argue that, as for irreparable harm, this amounts to voluntary cessation and a TRO/APA stay remains needed so the admin can't do this again.

Note: What DOJ had to file tonight was in response to a request for a temporary restraining order. This is not a response to the complaint in whole; it is opposing the TRO request. However, the likelihood of success on the merits is a part of that and generally argued in the opposition brief.

DOJ also argues that the plaintiffs lack standing, and if one plaintiff has standing, venue is improper in SDNY because he's in Alabama. (Again, not merits.)
Plaintiffs’ motion also should be denied for the additional, independent reason that they

lack standing.1
Plaintiffs assert standing under the “competitor advocate” theory, but they cannot
make the requisite showing that they compete “in the same arena with the party to whom the
government has bestowed the assertedly illegal benefit” so as to be “personally disadvantaged.” In
re U.S. Catholic Conference, 885 F.2d 1020, 1029 (2d Cir. 1989). Stated bluntly, the media
depictions of the President of which Plaintiffs complain do not “personally disadvantage” them
because they are not “personally compet[ing] in the same arena” with the party the media buys
purportedly benefit—President Trump. In addition, Plaintiffs acknowledge that their purported
injury is not redressable by this Court, demonstrating another reason why they lack standing.
Moreover, even if Plaintiffs could establish that Robert Hunter has standing, that would
not assist them because he resides in Alabama, the events relating to his alleged injury did not occur
in the Southern District of New York (“SDNY”), and Defendants do not reside in SDNY.
Accordingly, venue does not properly lie in SDNY for his claims. See 28 U.S.C. § 1391(e)(1);
Caremark Therapeutic Services v. Levitt, 405 F. Supp. 2d 454, 463-64 (S.D.N.Y. 2005)

BREAKING: In responding to one of two lawsuits challenging the legality of the Trump-praising DHS propaganda ads, DOJ tonight does not defend the ads on the merits — instead arguing that the ads are set to end on Sunday, so there will be no irreparable harm. storage.courtlistener.com/recap/gov.us...
PRELIMINARY STATEMENT
Plaintiffs' motion should be denied because the alleged improper final agency action of which they are complaining "run[ning] partisan political ads, funded by U.S. taxpayers," Plaintiffs' Brief in Support of Motion for a Temporary Restraining Order and Section 705 Stay (Pls. Br.") (ECF No. 26) at 1-will not continue past tomorrow, the date on which briefing on their motion for a TRO will close. As such, Plaintiffs cannot demonstrate that a TRO is necessary to prevent imminent irreparable harm to them from Defendants' future conduct.

Here was the request in which Jackson would have granted a stay:
Capital Case
Question Presented
In Atkins ». Virginia, Hall». Florida, and Moore ». Texas, this Court held that a State's determination of whether a prisoner is intellectually disabled must be informed by the medical community's current diagnostic framework. The current framework no longer requires —as it once did — that person's adaptive deficits be "directly related" to his intellectual impairment; in addition, the current framework now recognizes that the developmental period extends to age 22.
These two significant changes to the diagnostic criteria for assessing intellectual disability lead to the following question:
When an inmate's Atkins claim was rejected under obsolete diagnostic criteria but the inmate returns to the state court with evidence demonstrating he satisfies the existing criteria, do this Court's precedents or the Eighth Amendment require that the inmate's claim of intellectual disability be newly assessed in light of currently prevailing clinical standards?

NEW: Rep. Beatty is challenging the Kennedy Center's invocation of the qualified "presidential communications privilege" in refusing to turn over a vast array of communications with Trump & even documents "touching on" Trump communications during discovery. storage.courtlistener.com/recap/gov.us...
When Defendants filed their motion to vacate the preliminary injunction and for summary
judgment, they initially relied on evidence of what Trump told Defendant Matthew Floca. See,
e.g., Defs.'s Mem. in Supp. of Mot. 4, ECF 88-1; Defs.'s Statement of Undisputed Material Facts 14, ECF No. 89-2; see also Suppl. Decl. Charles Matthew Floca 1 6, ECF No. 29-3. But after

Plaintiff served written discovery, the Department of Justice pivoted to a sweeping claim of
presidential communications privilege to bar any inquiry into those communications, or indeed
into any inputs and instructions the Kennedy Center's staff received from its board chair. The
Department now refuses to provide any documents held by the Kennedy Center even touching on
communications between the Chairman and management and intends to block all inquiry into those
communications in depositions. Plaintiff does not bring this motion lightly. The Department's sweeping assertion of privilege, however, appears to be unprecedented. Donald Trump is the chair of a non-profit corporation's board, and his decisions and directions lie at the heart of that board's
actions which, in turn, are the subject matter of this case. Allowing Defendants to hide behind this unwarranted assertion of privilege would obstruct the search for the truth, frustrate the Court's discovery order, and undermine public confidence in these important proceedings.Having appointed himself to the Kennedy Center's board and having assumed the office
of Chair, Donald Trump undertook the obligations placed on him by the Center's organic statute
to safeguard and protect this sacred memorial to a fallen President. Trustee and board chair are
not roles that must be performed by the President of the United States and, indeed, never have been

in the Center's history before now. Nor are the staff at the Kennedy Center anything like the close presidential advisers whose conversations executive privilege protects. The Court should not
permit Defendants to evade accountability as trustees by abusing a privilege constructed for other
purposes, not the chairmanship of this non-profit entity. Plaintiff therefore respectfully requests the Court compel the production of responsive documents and written production Defendants improperly withheld.

First take out of arguments: A rough morning for Suncor. Tough to find five votes to get past the jurisdictional questions. Even if they do, the constitutional arguments did not have support. That leaves the Clean Air Act preemption argument, under which (at least) some claims are likely to survive.

"Gov. Lee calls off executions for rest of 2026" www.tennessean.com/story/news/c... Ah, yeah, I think so, buddy. But, also, let's be clear how little this is: Bill Lee calls off ... one execution date.

Gov. Lee calls off executions for rest of 2026

Tennessee Gov. Bill Lee is pausing all executions this year after Christa Pike survived two deadly doses of pentobarbital.
"Carrying out a lawfully imposed sentence is among the State's most serious responsibilities, and the people of Tennessee expect it to be done in a manner that is not only legal and constitutional, but is effective," Lee said in a statement Sept. 30.
Lee is calling for a "comprehensive, third-party review" of Pike's execution.
"Therefore, the remaining scheduled execution will not be carried out this year," Lee said.
Gary Wayne Sutton was scheduled for execution Dec. 3.

Statement from Christa Pike's attorneys Randy Spivey and Kelly Gleason from the TN
Office of the Post Conviction Defender, and Stephen Ferrell and Luke Ihnen from Federal Defender Services of Eastern Tennessee
Tonight the State of Tennessee once again failed to carry out a lawful execution. We take no pleasure in being right, but the concerns raised by Ms. Pike proved to be true: difficult vein access, blown veins, degraded pentobarbital, no emergency medical care available when things inevitably go wrong, all under a protocol that remains veiled in secrecy.
Christa is being treated at a nearby hospital. We have not been informed as to her condition.
