Did you know the USPTO converts all patent applications to TIFF files? We submit a DOCX application per their requirements and a PDF backup and they do a shitty conversion to TIFF and examine that. Make it make sense. Oh, you can't? No, you can't.

This kind of error is why we check the work of junior associates before filing and why we must check AI work before filing. It sounded great, but I knew it was the wrong test because I'm an experienced human lawyer.

It makes sense to me why this error was made: the ratio of work citing the old vs the new taking precedence over the recency of the work citing the new. I'll be updating the AI instructions to favor more recent citations when appropriate accordingly. But it will still make mistakes.

Another reminder that AI is like a decent junior associate. It gets a lot right, but it makes mistakes. Today mine cited case law that was recently overruled by a case that set a new test for patent obviousness. Most things the AI trained on cited the old case because the new case is relatively new.

It was encouraging to hear colleagues want to know how to use it properly and have a healthy wariness regarding privilege issues. It was alarming how many attorneys at ABA Tech Show had been using tools without considering privilege issues. I forget this stuff intimidates most attorneys.

I'm finishing up a 20-minute video and blog post about attorney use of AI and how way too many posts about the recent Heppner decision are misinterpreting the ruling. I felt a need to add in the beginning why I'm qualified to speak on the subjects. I wonder if I were a man if I'd have felt that. 🤔

Holy Emoluments Clause, Batman! Trump's trademark application filings regarding airports, were they to be granted, would put him in a position to demand licensing fees from the federal government for use of the marks if they cave and name any airports after him. That is wildly unconstitutional.

Very true. I don't have a problem with either, aside from using generative AI for dumb social media trend images and things like that. Generative AI does consume a good deal of energy, so until that's more energy efficient I'd prefer to see it used for more serious purposes. But I'm not in charge 😁

Step 7: Hire a patent attorney. We have technical degrees + legal training + passed a special patent bar. Claims must be drafted with surgical precision. One wrong word = worthless protection.
