BOULDER PARK: READ THE AGREEMENT FOR YOURSELF
There has been considerable discussion about
Charlottetown's $4.8-million purchase of Boulder Park - what City Council knew, what it authorized, and what restrictions were ultimately placed on the property.
Mayor Philip Brown says Council had all the necessary information before voting and that all the details were discussed in closed session.

Rather than asking anyone to take my word for it, I have now posted the underlying agreement online.
Schedule B is particularly important. It says Boulder Park must remain green space or parkland and that no amendment to its zoning or change in use is permitted without the prior written consent of both the Fathers of Confederation Trust and the Executive Council of Prince Edward Island.
The agreement was signed on behalf of the City by Mayor Philip Brown and Acting CAO Sue Fraser.
There are important questions still to answer:
Did Council expressly authorize these restrictions? What exactly was Council told before it voted? And can a private agreement lawfully constrain the planning authority of future City Councils?
I have requested the underlying City records and believe the legal question deserves independent review.
