Depends how the clause is written —sometimes they cover political unrest or government intervention — but Force Majeure doesn’t generally apply to simple nonperformance for economic reasons.

It’s easy to forget now that OpenAI started as a public charity. All the assets were to be held in public trust and used for charitable purposes. Somewhere along the line they gave away all the IP to the new for-profit. What did the nonprofit get in return? Was it fair market value? What did we get?

When @edzitron.com notes that MSFT is sitting in a pretty good position to scoop up OpenAI assets when the music stops, this is the genesis of their relationship. They came in relatively early, commingled the IP, and have much more flexibility than SoftBank.
