6/ Under Article 75 of the Federal Constitution, federal law reigns supreme. Any subsequent state planning approvals, land instruments, titles, or financial transactions concerning redevelopment on that illegally cleared site will be voided by the root illegality.

5/ Statutory immunity for public officials does not shield actions executed in direct defiance of a federal prohibitory statute. Furthermore, any unauthorized demolition leaves the site permanently poisoned by infected validity.

4/ To bulldoze SJK (C) Chung Shan, a developer or state entity must deliberately choose to breach a federal statute. The personal cost is severe. Section 117 pierces the corporate veil, making directors and officers corporate-liable for federal offenses under Section 112.

3/ Act 645 contains no balancing clause for development or airport expansions. The statute does not care about economic utility. The law is absolute: the Commissioner cannot grant a demolition permit for public convenience, but only under the condition of an imminent threat to safety.

1/ Let’s dissect the law on the Penang International Airport expansion vs. SJK (C) Chung Shan. Most believe a historic site requires formal gazetting to be protected. This is legally incorrect. Under the National Heritage Act 2005 [Act 645], heritage is an inherent status.

One of the finest Art Deco enclaves in Asia - Burmah Square in George Town, Penang - is planned to be destroyed by a 27 story high rise complex with shopping malls and apartments. Most homes there are still intact and have not been changed since the 1920s. Please sign to help save it.
