Telling a subset of people they're ineligible for a medical procedure because the system is failing them is in and of itself failing them. Cruel and unusual punishment for those that just want their illness to be taken seriously and to have access to the same medical care afforded to others.

So Oct 10 is World Mental Health Day. Health Canada will as usual issue a statement - don't suppose they'll acknowledge they just announced an indefinite commitment to the following statement "a mental illness is not considered to be an illness, disease, or disability" - you wrote it, you own it.

First has been shown to have been illegitimate (e.g., Co-Chairs went in opposed to MAiD and did not exercise authority as Chairs in unbiased way, didn't hear from those being excluded, one Co-Chair suggested people with mental illness can just access fentanyl) 2/3

And there it is. The "Party formerly known as the Party of the Charter" has decided put MAiD for mental illness with advance requests for MAiD in one piece of legislation - clearly hoping Senators will throw people with mental illness under the bus in order to get advance requests.

With a vote on Bill C-218 today, it felt appropriate to re-up my personal reflection on MAID for mental illness one more time with feeling. Fuck the institutions who support people with mental illness who put their influence behind this bill.

Finally a judge will look at the passage of time and timelines will be set that the government lawyers will need to meet. It will still take time to get to trial but at least it won't be interminably indefinite.

Of course this doesn't diminish the pain of those who have been waiting for a glimmer of hope in this process only to be met with an egregiously dysfunctional AMAD Committee and an unconscionably slow-to-respond Attorney General. While they aren't listening, know that we are and will keep fighting.

This explains perfectly what the decision did and did not decide. DID NOT decide whether the exclusion of MI-SUMC is constitutional. DID decide Attorney General needs to stop dragging its heels.

Today’s decision did NOT uphold Canada’s exclusion of people with mental disorders from MAiD. The court denied Brosseau an individual exemption while her challenge proceeds. The judge has now ordered that challenge to move forward. Canada will finally have to defend the mental illness exclusion.

Remember, no individual is required to participate in MAiD. This is about allowing willing providers to provide to patients who meet all the eligibility criteria and procedural safeguards - by definition, they are experiencing enduring and intolerable suffering.
