The case, Guzman v. D.H.S., challenges ICE’s widespread policy of “arrest first, ask questions later” as a violation of the Fourth Amendment and federal statutes. The preliminary injunction requested in the lawsuit would prohibit ICE from continuing this practice during the litigation.

Good news: recent wins from across the movement. 

1. Data sharing between the IRS and ICE blocked in court: A court upheld the block on the “Data-Exchange Procedure,” which had allowed the Internal Revenue Service (IRS) to share taxpayer data with I.C.E.

2. Use of the modified SAVE system for voter purges blocked: Use of the modified SAVE system (used for voter purges by making citizenship and immigration status of nearly all Americans searchable remains blocked.

3. New Jersey prohibits use of state resources for federal immigration enforcement: A federal court dismissed a lawsuit brought by the Trump-Vance administration challenging New Jersey’s policy restricting U.S. Immigration and Customs Enforcement (ICE) activity.

WIN: A federal appeals court blocked the IRS from disclosing a massive amount of taxpayers data to ICE. The Trump-Vance admin’s dangerous data sharing policies violate the privacy rights of millions of Americans. The court has affirmed - yet again - that this behavior is unlawful.

In addition to the money, this case resulted in policy changes for everyone incarcerated at Lowell Correctional Institute. And - the doctor named in the lawsuit was fired. Grateful to our grantee Florida Legal Services for their work on this case.

On this day in 1965, the Voting Rights Act was signed into law. In the last 10 years, the Voting Rights Act has been weakened by court decisions such as Shelby County v. Holder. This election cycle, while we still have open voting, make your voice heard.

A majority of Supreme Court justices ruled today that the Trump administration may turn back asylum seekers at ports of entry along the U.S.-Mexico border. We lament today’s SCOTUS decision in Mullin v. Al Otro Lado, and concur with Supreme Court Justice Sonia Sotomayor in her dissent.

Two wins from last week you might have missed! 1) A district court blocked Trump from defunding NPR and PBS, ruling that EO 14290 was unconstitutional. 2) A district court blocked the Trump-Vance administration from terminating $10 billion in child care, family assistance, and housing funds.

The courts, over the past year, have provided a significant guardrail because of the power of people.

Because people have stood up in what is now nearly 700 cases – the largest effort we’ve seen against this administration.

And the president is losing 70% to 80% of the time.It was not surprising to us, as lawyers, when we started seeing the millions who came out for No Kings, the largest single-day mobilization of people in U.S. history.

Because we had been seeing it with people in court.

This year will be highly litigious; we will be in court every single day. The fight is going to require all the lawyers, but ultimately, it is going to be the people.
