The new bit is a general-purpose agent being given a lawful objective and independently choosing an unlawful means to achieve it. That’s why the mens rea attribution question is different. Anyway. If the agent chose the illegal route itself, you can’t just say “whoever wrote the software” and call it solved. Criminal responsibility still has to attach to an actual person or the company somehow. 100
