Hi! I don't think so because generally you have to intentionally cause damage or intend to access the computer. And for civil cases "no action may be brought under this subsection for the negligent design or manufacture of computer hardware, computer software, or firmware."

By framing this as "just a computer", you are willfully ignoring the privacy-related differences between desktops and mobile phones. Chatrie applies to location information as we move through the world, whether generated by smartphones, tablets, or chips in our brains.

A smartphone is "just a computer" like a calculator is just a computer like an AI chatbot is just a computer. The cultural ramifications of each are completely different. That is why everyone talks about the introduction of the iPhone in 2007 as revolutionary.

People say they want giant cars because they are "safer". Safer for whom? Weigh the fractional benefits to the passengers with the devastating consequences to pedestrians and bikes. No one wants to die OR kill someone else in an accident. Think about both before you buy.

Brooke Jenkins's SF DA's office won't file conspiracy or accomplice charges against police officers who participated in and/or covered up a sexual assault, but anti-genocide protestors on the bridge face conspiracy charges carrying potentially 14 years in prison. We said this would happen.

Stewart Baker didn't just talk, he acted. As General Counsel of the National Security Agency, and in his DHS role, he instantiated his objectionable ideas in law, policy, and practice. Maybe he was fun on a panel, but behind his humorous quips lies a more problematic legacy.

I don't think that the virtual locker argument maps well onto content/non-content. If I have info in a locked area, it doesn't matter if it is content or not -- if you have to invade the area to get the info, it's a search. Similarly, the 3d party doctrine doesn't apply to some content e.g. email.
