MINUTE ORDER denying the 121 Defendants' Motion to Reconsider August 31, 2026, Minute Order. On August 31, 2026, the Court directed the Parties to appear for a hearing on the pending 108, 110 Motions for Summary Judgment and ordered the Defendants to make agency decisionmakers from each of the Defendant agencies available for testimony at that hearing. That Minute Order stands. The Defendants' 121 reconsideration motion is based on a misperception that the ordinary standards set forth in Federal Rule of Civil Procedure 56 apply to cases filed under the Administrative Procedure Act (APA). Indeed, the Defendants cite Rule 56 more than 20 times in their motion and go as far as saying that the Court should deny both motions (and presumably go to trial) if the record before the Court is inadequate or insufficient for the Court to resolve the summary judgment motions. But the ordinary Rule 56 inquiry into whether a genuine dispute of material fact requires a trial does not apply to a court's review of agency action under the APA. Am. Bioscience, Inc. v. Thompson, 269 F.3d 1077, 1083–84 (D.C. Cir. 2001) ("As we have repeatedly recognized, . . . when a party seeks review of agency action under the APA, the district judge sits as an appellate tribunal. The 'entire case' on review is a question of law."); Sierra Club v. Mainella, 459 F. Supp. 2d 76, 89 (D.D.C. 2006) ("In a case involving review of a final agency action under the Administrative Procedure Act, 5 U.S.C. § 706, . . . the standard set forth in Rule 56(c) does not apply because of the limited role of a court in reviewing the administrative record."); see also LCvR 7(h)(2). The Court proceeded to discovery in this case because the Parties agreed that limited discovery was necessary on the contrary-to-law claim. After being hacked by ShinyHunters, the FBI jobs site and the Special Agent Application Tracking Portal is still out of service. 🤣 The hackers stole data on ALL of the FBI agents and employees. I'm assuming they also exfiltrated all of the data on the applicants who didn't get hired. #SoMuchWinning

SCOTUS Denies Rehearing for E Jean Carroll Case - Trump lost his defamation lawsuit, and so the lower court already made him pay her plus interest. He petitioned SCOTUS and it was denied. He then petitioned for a re-hearing and it was also denied. This case is over, but one other is still pending. ⚖️

A Mad King - He's insane! 🤡 North Korea has advanced their missiles to reach the US, while sending weapons/troops to fight in Russia against Ukraine. Trump is on the side of Putin and North Korea! And he's still furious at South Korea staying out of the war with Iran that he lost. Complete madness:
Based on my very good relationship with Kim Jong Un, of North Korea, I am not happy with the fact that the United States has, long ago, agreed to participate in Joint Military Exercises with South Korea. These exercises are not only costly, with much of these costs paid for by the United States of America (as usual!), but send a signal that is totally inappropriate and hostile, to a Country that, as long as Donald J. Trump has been President, has been unthreatening and respectful. Therefore, and based on the fact that it was too late to cancel, I have instructed Secretary of War, Pete Hegseth, to substantially reduce the Joint Military Exercises! While somewhat unrelated (?), I recently asked the President of South Korea if they would like to join us in the Denuclearization of the Islamic Republic of Iran, and they said, "No thanks!" St. Mary Catholic Parish v. Roy - In the next SCOTUS term, they'll hear a case about whether Colorado can withhold state funds from schools because they won't agree to nondiscrimination against LGBTQ+ students. IMHO taxpayers shouldn't fund religious institutions, period! I'm watching this case: 🏳️‍🌈🏳️‍⚧️

Colorado's so-called universal preschool program pays for families to send their children
to the preschool of their choice, public or private. To participate, preschools must ensure all
families have an "equal opportunity" to enroll regardless of, inter alia, race, religious affiliation,
sexual orientation, gender identity, income level, or disability. Colorado nonetheless permits
numerous exemptions from this requirement, both categorical and discretionary, allowing
preschools to admit only "children of color," "gender-nonconforming children," "the LGBTQ
community," low-income families, and children with disabilities. But Colorado excludes Catholic
preschools because they admit only families who support Catholic beliefs, including on sex and
gender.
The Tenth Circuit upheld Colorado's decision to exclude Catholic preschools. Applying
Employment Division v. Smith, it held that Colorado's secular exemptions and discretion did not
undermine general applicability. In so doing, the court sided with the minority position in an
entrenched and acknowledged 7 -4 split over what kinds of exemptions and discretion
undermine general applicability. The court also eschewed Carson v. Makin, concluding that its
rule was inapplicable because Colorado's exclusion was not "on the explicit basis" of religion.
The questions presented are:
1. Whether proving a lack of general applicability under Employment Division v. Smith
requires showing unfettered discretion or categorical exemptions for identical secular conduct.
2. Whether Carson v. Makin displaces the rule of Employment Division v. Smith only
when the government explicitly excludes religious people and institutions.
 3. Whether Employment Division v. Smith should be overruled

There's Always Somebody 🤡 - I announced on NextDoor the upcoming weekend of Good Trouble Lives On, and of course someone felt the need to comment that "Good trouble is a term that turns my stomach." I probably shouldn't have responded, but there's no way I was going to let that slide. My response:😎
Response: "sam I'm not sure how anyone would find encouraging people to vote and having the right to vote to be offensive, unless you're against democracy. If so, that says a lot about you. John Lewis was beaten bloody by police and jailed just for trying to exercise his rights. Perhaps you don't know the true meaning of "Good Trouble" and in that case I have you covered. There are links to documentaries about it in the document I linked to, so maybe learn some Alabama history and it will settle your stomach?"

Alabama 4th of July - My husband and I went to see the fireworks in Montgomery at the Crampton Bowl stadium. There was a very diverse and friendly crowd. Like all military bands, the 151st Alabama Army National Guard Band was excellent! Lots of kids and activities for them. 11 minutes of fireworks.

Selma Where It Began - On Saturday, my husband and I took a field trip to Selma, Alabama where the march for equal rights began. I'm so sad that the Voting Rights Act was neutered by the Supreme Court, but I've never been more determined to fight for a new VRA and for full equality for everyone. ✊

We lost Iran war. Despite lies by media and Trump regime, only thing to negotiate is Trump's surrender. They're not even close to deal as good as Obama's JCPOA. We didn't destroy IRCG and Strait is closed. Iran has always said the nuclear discussion is off-the-table. Here's what Iran's media says:

On my right screen I'm watching a documentary on Rev Fred Shuttlesworth and seeing police in Birmingham, Alabama use a tank, fire hoses, batons, and attack dogs on peaceful protesters in the 1960's. On my left screen, I'm watching police, ICE, and GEO security use tear gas, a Bearcat, horses, batons, pepper spray, and flash bangs against peaceful protesters outside Delaney Hall in  Newark, New Jersey. It's 2026, and not much has changed. 😭#AbolishICE

Civil Rights Memorial Center - We visited museum where Emmett Till / Mamie Till-Mobley exhibit will be until August. We went to historic Ben Moore Hotel and Majestic Cafe. Many famous people like MLK have stayed there, and many musicians like Little Richard performed there. The March continues! ✊

Thirty More #SCOTUS Opinions Left -There are still lots of huge cases left like trans rights, executive power, 2nd Amendment, etc. I had lost count, so I asked SCOTUSblog how many more Supreme Court decisions were left to be released between now and the end of June. Their answer is 30. 😭

A Quick Sanity Check - With all of the lies told by our government and the media, I just double-checked the meaning of a ceasefire with the Merriam-Webster Dictionary. Neither the "ceasefire" in Iran or Gaza is legitimate, as long as both sides don't cease firing at each other. 🤬

Mixing in Dolby Atmos is wild and may be the end of my sanity! There are 7 surround speakers, 1 bass speaker, and 4 ceiling speakers (Dolby 7.1.4). I can place 128 objects at a time in 3D space to make it sound like bullets whiz by your head, or a helicopter is flying above, etc.
