Mexico joined the kids online protection regulation wave in the sloppiest way possible. An executive order (with no legal basis). Broad age verification mandate. Broad definition of platforms covered. Broad categories of speech with access restrictions and even removal for everyone. And more!

The Mexican government published an "Executive Order on Safe Digital Environments for Children and Teenagers". There were some law proposals in Congress on this topic, but a shooting in a school 2 weeks ago seems to have precipitated this action. You can read it here: dof.gob.mx/nota_detalle...

The first thing to note is the lack of legal basis. The government bases this EO (Decreto) on very shaky foundations. Mainly, very broad articles in the Children and Teenagers General Law that recognize children's right to safe access to the Internet and the State's obligation to prevent abuse.

Weirdly, the EO also cites the EU DSA as a justification for this action. Move over Canada, Mexico is joining the EU first! In all seriousness, no serious constitutional lawyer can say the government can order platforms to restrict freedom of expression and privacy in this way via an EO (Decreto).
Que, en el marco internacional, la Unión Europea, a través del Reglamento (UE) 2022/2065 del Parlamento Europeo y del Consejo de 19 de octubre de 2022, relativo a un mercado único de servicios digitales y por el que se modifica la Directiva 2000/31/CE, se determinó que los prestadores de servicios intermediarios deben disponer de mecanismos electrónicos para denunciar contenido ilícito y tramitar las denuncias de forma oportuna y objetiva, comunicar sus decisiones y permitir reclamaciones, sin fijar un plazo general para retirar cualquier contenido, no obstante las medidas pueden incluir eliminación, bloqueo de acceso o reducción de visibilidad, según corresponda;

Art. 1 says these provisions are "mandatory," although the EO does not establish any sanctions for non-compliance. However, the president threatened to push for legislation if companies don't comply within 30 days. Which companies? Take your guess. Art. 2 definition is as broad as it gets.

The "Platform" definition explicitly mentions social networks, video games, and app stores, but the definition is so broad that even E2E messaging apps, streaming services, and more would fall under the definition. Really sloppy work.

Art. 4 establishes further obligations for "Platforms", notably: Age verification. Platforms must identify the age of all users. Self-reporting is banned. So seems like it's ID-based verification (mass surveillance and data breach risks) or discriminatory AI/Facial recognition age estimation.
I.     Implementar mecanismos confiables y seguros para identificar la edad de las personas usuarias de sus servicios. Dichos mecanismos no deberán limitarse a la autodeclaración de las personas usuarias para la acreditación de la edad;

It seems the EO was rushed and put together in very little time by people with very little knowledge of the issues, but Platforms will have even less time to implement it. Actually none. The EO was published yesterday afternoon, and today it is already in force. Not serious people.

A large section of the public is rightly concerned, anxious, and angry about the power that a few tech companies are accumulating. It is a shame that this sentiment is wasted on regulation that does little (worse) for people's rights and even less to actually question Big Tech's power.

Anyway, this EO should be challenged in court, and any reasonable judge should recognize its flaws, but it seems platforms won't do it, and there are not many of those anymore (reasonable judges) after a judicial reform that demolished the independence of the judiciary in Mexico.
