Kirby v. Duva 2008 states that deadly force cannot be used to prevent the escape of an unarmed, non-dangerous fleeing suspect. Use of deadly force may be deemed excessive if the officer UNREASONABLY PLACES THEMSELVES in harm's way in the first place, rather than utilizing safer alternatives.
