10 years ago today, I and my friends Annette, Ken, Leonard, & Michael shut off (or caused the shutoff of) all 5 tar sands crude pipelines coming into the US in Minnesota, N. Dakota, Montana, & Washington. For a little while, we halted the progress of one of the most destructive projects on Earth.

Right back at you! But let's say...co-conspirator!

I’m just grateful to be alive on a sun-dappled Sunday morning in my gorgeous corner of this overwhelmingly beautiful planet, and aware of the power that we all have to fight for it, and fight for each other. What better way to spend a life? The coming months & years need us: dig in.

I’m not sure that even Big Tech—with its deep pockets & puppet president—could find a jury that would convict in such a case. (As @charlieberens.bsky.social said, hating data centers is the most bipartisan thing since beer.) So maybe at some point I’ll run that experiment. But for now...

These days, I shut off pipelines indirectly: I organize against data centers, because they're by far our biggest climate threat— by far the biggest growth of fossil fuel use, worldwide. Our work is entirely legal…but I do wonder what would happen if activists shut down the road here, for example:

You can’t really know precisely which things spurred it, or when the momentum became irresistible. This is true of negative AND positive change: it has so many parents, so many moments when small actions by people who believe themselves powerless could have made (or did make) all the difference.

Emily Johnston @enjohnston.bsky.social · 8h
Was it worth it? Did we accomplish anything? Yes, and I think so. But these are the wrong questions; the answers are unknowable. Change develops mysteriously: people do things out of love & hope & anger & determination…and eventually, there's an undeniable shift, sometimes tectonic.
173
Emily Johnston @enjohnston.bsky.social · 8h
but we're not. Turning off a pipeline is obviously a niche act—but every day, there are myriad ways we can stand up to the business-as-usual that’s threatening literally everything we love & depend on, & we spent years after the action talking to people, trying to shake them out of hopelessness.

Emily Johnston @enjohnston.bsky.social · 8h
Most people know that climate change is an enormous threat. Most people know the oil companies lie. Most people worry about the world their kids face—even the world we’re all in right now. I really like most people—that’s part of why I was willing to risk going to prison. Most people feel powerless—

Emily Johnston @enjohnston.bsky.social · 8h
If someone did this today, being old & white wouldn’t be enough to ensure their safety, I assume a federal case—with a direct line to the profoundly compromised Supreme Court if need be—would be the result if one did make it that far. There’s no rational audience—except, of course, for most people.

Instead, a few months later, 84 U.S. reps wrote to AG Jeff Sessions urging him to prosecute us as terrorists for our “sabotage” (the only damage was to the locks that we broke to get into the shutoff valve enclosures; otherwise we used the equipment as intended: shutoff in case of emergency).

Emily Johnston @enjohnston.bsky.social · 8h
It was a different era, & we were naive enough that we never had a "what if" conversation about the election a few weeks later. That was...a nasty shock. We’d been assuming an intelligent & well-intentioned national interlocutor; we'd posted a letter to Obama immediately after the action.
182
Emily Johnston @enjohnston.bsky.social · 8h
We’d planned the action very carefully, to ensure that it would be safe & have a chance of being effective. Could we pull it off? (yes.) Could we get the necessity defense & put on a groundbreaking trial? (SO CLOSE!) Could we bring sustained attention to our dire climate trajectory? (for awhile.)

Reflections from the Minnesota Valve Tuners Trial - Climate Disobedience Center
The primary lesson reinforced by the Minnesota Valve Turners Trial is that with climate necessity defense trials, and other political trials, you never know

Annette’s and my charges started out at 35 years; in ND, our friend Michael’s started at 99 years; our expectation was that convictions would probably mean about 2 years in prison, as had been the case for Tim DeChristopher. In the end, only Michael went to prison (for six months).
163
Emily Johnston @enjohnston.bsky.social · 8h
We also stood a good chance of meeting one standard of the necessity defense, which requires you to have tried the OTHER avenues to preventing the harm, before breaking the law—and we all had: protest, organizing, op-eds, getting out the vote, policy advocacy, you name it: we’d done it for years.
181
Emily Johnston @enjohnston.bsky.social · 8h
We were all older white folks (at 50, I was the youngest), and thus unlikely to be harmed in the process of arrest. When the sheriff came to arrest my friend Annette & me, the first words out of his mouth were “well, you don’t LOOK dangerous.” He didn’t even cuff us.
162
Emily Johnston @enjohnston.bsky.social · 8h
There’s historical precedent that you can break a law if NOT breaking it would result in greater harm; the necessity defense seeks to prove this. If you walk by a burning building & hear a baby crying, it’s NOT illegal to break in & save the baby. (Nor to shut the gas line to that building, ahem.)
181
Emily Johnston @enjohnston.bsky.social · 8h
It was remarkably easy to do, because we weren’t trying to avoid capture; we called ahead to warn the companies, and later waited to be arrested, because we wanted to try for climate “necessity defense” cases in the 4 states (we ended up getting partial versions in 2 states)…

My question is, if activists blockaded the road in, would a jury convict? I...don't think so.

Am I the only one that thinks that if you're an AI engineer at a company that you think is being irresponsible with its AI...you have a responsibility to stay and disarm it in any way that you can? I mean...appropriate national legislation is gonna be awhile.

Concrete/steel CAN be made greener, & those versions are advancing fast. There will never be anything green about a massive new use of wood. Clear-cut logging is a disaster, & this image doesn't even account for the soil carbon (over half of the carbon in forest!) emitted by use of heavy machinery.
"Fate of carbon from harvested wood" image showing that only about 15% of the carbon is stored in the wood product--the rest is emitted by logging residue, mill residue, and transportation.

Ahem, a masterclass in what we cannot do if we want climate stability. Mass timber—at least in the PNW, I don't know about elsewhere—is mass disaster. There's no such thing as climate-friendly logging at the scale that this would require. Mass timber must remain a VERY niche product.

It's not like it's a rowdy place. Or even a late one. Or has outdoor music. I go to bed early. Really early—in the summer, when it's still kinda light out. That doesn't mean my neighbors can't ever have a dinner in their yard and enjoy the summer night. That's what fans are for! This is a CITY.
