I did go to law school and you are right - although the First Amendment states that Congress shall make no law abridging freedom of speech or of the press, courts have long interpreted that to apply to the executive branch as well.

EPA knew. They did testing of the air and it came back hazardous. Rather than reveal that, EPA was ordered to back off. The EPA agents were then sent to the Pentagon (which also got hit) to collect body bits. And to not tell anyone what was in the WTC zone zero air bc people might freak out.
