I post photos and share content and text, both personal (pictures of my self, family and friends) and share work that I own the Copyrights to, on Instagram and Facebook.

A few days ago I heard the news that EDPB will granted Meta the right to train their AI on public posts on Instagram and Facebook. My only option for dealing with this is to "opt-out".

There are a series of problems with this:
1. I only heard of this AFTER Meta has already started trawling through public posts. News reports differ, but I have the impression that they started already on the 14th of April, which means that its too late to opt-out due to the nature of these AI models and how they are trained.
2. Even if I do Opt-out, others on social media are uploading images and content related to me, that can be tied to me through these AI in ways that would violate GDPR.
3.  There are others who upload my copyright protected material, both with and without permissions from me, that I now have to reach out to and plead to opt-out of AI training in time to avoid my work from being used.
4. If Meta trains a model like LLAMA and uploads the weights as part of an "Open Source" project, my data will be included in perpetuity. 

This seems like a bad decision from EDPB that defies the interests of European citizens and my rights under GDPR, data protection and international copyright agreements like the Berne Convention Article 9(2) (because companies train AI models on photographers and artists works to compete with them).

I would like to know if you intend to flag this or escalate a case to be taken up in the EDPB.

When the billionaires express their desires, it often becomes clearer what positions are in their interests and not the public. Copyright enables small creators to make a living off their work with legal protections. It protects things that are hard to make but easy to copy.

Legalizing AI scraping of the internet will only lead to even more malicious botnets sucking away all bandwidth for websites, where the benefits go to the scraper, & all the costs on the hosts of websites. Legalized destruction of the commons. Jonathan Corbet says the technical in laymens language:
 LWN was born in the era when the freedom to put a site onto the Internet was a joy to experience. That freedom has since been beaten back in many ways, but still exists for the most part. If, though, we reach a point where the only way to operate a site of any complexity is to hide it behind one of a tiny number of large CDN providers (each of which probably has AI initiatives of its own), the net will be a sad place indeed. The humans will have been driven off (admittedly, some may see that as a good thing) and all that will be left is AI systems incestuously scraping pages from each other.

Journalists, knowledge workers, artists, and creatives of all sorts recognise the unfairness built into the current AI paradigm. How it negatively affects their relationships with their work. How it funnels value away from the people who produce the value. It is the same fight.

What an excellent observation: you are entirely correct. Mistral also prides itself on being "transparent and trustworthy", yet when they released Mistral-7b, they did not reveal the training data, and as far as we know, have not disclosed it since.
